NOTICE OF FORECLOSURE SALE

Please Take Notice that the above-entitled Court, having duly appointed a Special Master in this matter with the power to sell, has ordered me to sell the property located at 2901 Vista Grande Drive N.W., Albuquerque, NM 87120, more fully described as:

LOT NUMBERED TWENTY-EIGHT (28) IN BLOCK LETTERED “I” OF THE REPLAT OF BLOCKS, D, E, G, H, AND I, OF THE PALISADES, AN ADDITION TO THE CITY OF ALBUQUERQUE, NEW MEXICO, AS THE SAME IS SHOWN AND DESIGNATED ON THE REPLAT OF SAID ADDITION, FILED IN THE OFFICE OF THE COUNTY CLERK OF BERNALILLO COUNTY, NEW MEXICO, ON MARCH 14, 1967, IN PLAT BOOK C6, FOLIO 163.

The property will be sold subject to rights of redemption; easements, reservations and restriction of records; taxes and governmental assessments; any liens or encumbrances not foreclosed in this proceeding; environmental contamination, if any, and zoning violations concerning the property, if any.

A Stipulated Default Judgment was entered in the above captioned and numbered cause against the Defendants in favor of MARINERS STRATEGIC FUND, II, LLC, A CALIFORNIA LIMITED LIABILITY COMPANY, on September 20, 2011, in the amount of $136,486.89 plus interest at the rate specified in the Stipulated Default Judgment from July 30, 2011.  The sale is to begin at 9:30 a.m. on November 1, 2011, at the front steps of the Bernalillo County Courthouse, located at 400 Lomas NW, Albuquerque, New Mexico at which time I will sell to the highest bidder for cash the above-described Real Estate and all improvements thereon to pay the expenses of such Judgment referred to above, and to satisfy the total amount of the Stipulated Default Judgment plus interest to the date of the foreclosure sale and the costs of the foreclosure sale.  At such sale, the Plaintiff, of MARINERS STRATEGIC FUND, II, LLC, A CALIFORNIA LIMITED LIABILITY COMPANY, may become the purchaser of the property being sold, or part thereof, and may apply all or part of the Judgment to the bid, should it be the highest bidder.  The appointed Special Master may postpone and reschedule the sale without further publication.
