NOTICE OF SALE ON FORECLOSURE

PLEASE TAKE NOTICE that the above-entitled Court, having appointed me or my designee as Special Master in this matter with the power to sell, has ordered me to sell the real property (the “Property”) situated in Socorro County, New Mexico, commonly known as 209 Barreras Circle Southwest, Socorro, NM 87801, and more particularly described as follows:

A CERTAIN PIECE OF PARCEL OF LAND AND REAL ESTATE SITUATED WITHIN THE CORPORATE LIMITS OF THE CITY OF SOCORRO, SOCORRO COUNTY, STATE OF NEW MEXICO, WITHIN SECTION 21, OF THE TOWN OF SOCORRO GRANT, LYING GENERALLY WEST OF BARRERAS CIRCLE STREET, SOUTH OF LANDS NOW OR FORMALLY OF DONICIO AND MARY ZAMORA, EAST OF LANDS NOW OR FORMALLY OF ARISTEO GONZALES AND NORTH OF AN ENTRANCE WAY, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS, TO WIT:

BEGINNING AT THE NORTHEAST CORNER OF THE PARCEL HEREIN DESCRIBED FOR CORNER NO. 1, SAID POINT LYING ON THE WEST USE LINE OF BARRERAS CIRCLE STREET WHENCE THE SOCORRO GRANT SECTION CORNER COMMON TO SECTION 15, 16, 21 AND 22 BEARS N. 49° 23’ 30” E., 3,511.88 FEET;

THENCE, ALONG THE WEST USE LINE OF SAIDBARRERAS CIRCLESTREET S. 03° 27’ 06” E., A DISTANCE OF 92.70 FEET TO CORNER NO. 2 FOR THE SOUTHEAST CORNER OF THE PARCEL HEREIN DESCRIBED;

THENCE, LEAVING THE WEST USE LINE OF SAIDBARRERAS CIRCLESTREET S. 81° 54’ 33” W., A DISTANCE OF 97.50 FEET TO CORNER NO. 3 FOR THE SOUTHWEST CORNER OF THE PARCEL HEREIN DESCRIBED;

THENCE, N. 10° 47’ 38” W., A DISTANCE OF 81.00 FEET TO CORNER NO. 4 FOR THE NORTHWEST CORNER OF THE PARCEL HEREIN DESCRIBED;

THENCE, N. 75° 53’ 09” E., A DISTANCE OF 109.42 FEET TO THE POINT AND PLACE OF BEGINNING.

The sale is to begin at 3:45 P.M. on Friday, January 27, 2012, on the front steps of the Seventh Judicial District Courthouse, City of Socorro, County of Socorro, State of New Mexico, at which time I will sell to the highest and best bidder for cash in lawful currency of the United States of America, the Property to pay expenses of sale, and to satisfy the Judgment granted DEUTSCHE BANK NATIONAL TRUST COMPANY, AS TRUSTEE FOR SOUNDVIEW HOME LOAN TRUST 2006-WF2.

DEUTSCHE BANK NATIONAL TRUST COMPANY, AS TRUSTEE FOR SOUNDVIEW HOME LOAN TRUST 2006-WF2 was awarded a Judgment on November 17, 2011, in the principal sum of $40,846.39, plus outstanding interest on the balance through October 3, 2011, in the amount of $2,390.51, plus late charges of $194.56, plus escrow balance in the amount of $413.56, plus corporate advance in the sum of $610.00, plus other fees in the amount of $30.00, plus attorney’s fees in the sum of $900.00 and costs through November 15, 2011, in the sum of $1,142.40, with interest on the Judgment including late charges, property preservation fees, escrow advances, attorney’s fees and costs of this suit at the rate of 5.375% per annum from date of the entry of the Judgment until paid.

NOTICE IS FURTHER GIVEN that the real property and improvements concerned with herein will be sold subject to any and all patent reservations, easements, all recorded and unrecorded liens not foreclosed herein, and all recorded and unrecorded special assessments and taxes that may be due.  DEUTSCHE BANK NATIONAL TRUST COMPANY, AS TRUSTEE FOR SOUNDVIEW HOME LOAN TRUST 2006-WF2 and its attorneys disclaim all responsibility for, and the purchaser at the sale takes the property subject to, the valuation of the property by the County Assessor as real or personal property, affixture of any mobile or manufactured home to the land, deactivation of title to a mobile or manufactured home on the property, if any, environmental contamination on the property, if any, and zoning violations concerning the property, if any.

NOTICE IS FURTHER GIVEN that the purchaser at such sale shall take title to the above described real property subject to a one (1) month right of redemption.
