NOTICE OF SALE ON FORECLOSURE

PLEASE TAKE NOTICE that the above-entitled Court, having appointed me or my designee as Special Master in this matter with the power to sell, has ordered me to sell the real property (the “Property”) situated in San Juan County, New Mexico, commonly known as 5218  St Andrews Drive, Farmington, NM 87402, and more particularly described as follows:

LOT TWO (2) IN AREA A OF SAN JUAN COUNTRY CLUB ESTATES,  PHASE ONE, REPLAT “B”, IN THE CITY OF FARMINGTON, SAN JUAN COUNTY, NEW MEXICO, AS SHOWN ON THE REPLAT THEREOF FILED FOR RECORD MAY 23, 1997, MAP FILE S289 AND ESTABLISHED BY THE DECLARATION OF SAN JUAN COUNTRY CLUB ESTATES, LTD., AS RECORDED IN BOOK 936, PAGE 45 AND IN BOOK 936, PAGE 387 AND DECLARATION RECORDED IN BOOK 1248, PAGE 849, AMENDED IN BOOK 1374, PAGE 960 OF THE RECORDS OF SAN JUAN COUNTY, NEW MEXICO.

The sale is to begin at 11:45 AM, on March 21, 2012, on the front steps of the Eleventh Judicial District, City of Farmington, County of San Juan, State of New Mexico, at which time I will sell to the highest and best bidder for cash in lawful currency of the United States of America, the Property to pay expenses of sale, and to satisfy the Judgment granted Wells Fargo Bank, N.A.

Wells Fargo Bank, N.A. was awarded a Judgment on January 23,2012 in the principal sum of $183,032.89, plus outstanding interest on the balance through January 11, 2012,  in the amount of $5,399.04,  plus escrow advance in the amount of $842.38, plus corporate advances in the amount of $40.00, plus fees billed in the amount of $40.00, plus attorneys fees in the sum of $950.00 and costs through January 18, 2012, in the sum of $795.68, less a suspense balance of (746.05), with interest on the Judgment including late charges, property preservation fees, escrow advances, attorney’s fees and costs of this suit at the rate of 4.25% per annum from date of the entry of the Judgment until paid.

NOTICE IS FURTHER GIVEN that the real property and improvements concerned with herein will be sold subject to any and all patent reservations, easements, all recorded and unrecorded liens not foreclosed herein, and all recorded and unrecorded special assessments and taxes that may be due.   Wells Fargo Bank, N.A., and its attorneys disclaim all responsibility for, and the purchaser at the sale takes the property subject to, the valuation of the property by the County Assessor as real or personal property, affixture of any mobile or manufactured home to the land, deactivation of title to a mobile or manufactured home on the property, if any, environmental contamination on the property, if any, and zoning violations concerning the property, if any.

NOTICE IS FURTHER GIVEN that the purchaser at such sale shall take title to the above described real property subject to a one (1) month right of redemption.
