NOTICE OF SALE ON FORECLOSURE

PLEASE TAKE NOTICE that the above-entitled Court, having appointed me or my designee as Special Master in this matter with the power to sell, has ordered me to sell the real property (the “Property”) situated in San Miguel County, New Mexico, commonly known as 907 Don Fidel St, Las Vegas, NM 87701, and more particularly described as follows:

A TRACT OF LAND SITUATE WITHIN BLOCK I, TOWN OFLAS VEGAS,SANMIGUELCOUNTY,NEW MEXICO, MORE PARTICULARLY DESCRIBED AS FOLLOWS:

BEGINNING AT STAKE SET IN GROUND AT THE SOUTHEAST CORNER OF THIS LOT ON WEST LINE OF ALLEY BETWEEN BLOCKS “I” AND “J”, FROM THE SAID STAKE THE INTERSECTION OF THE NORTH LINE OF SAPELLO STREET WITH THE WEST LINE OF PACIFIC STREET AS ESTABLISHED AT THIS TIME AUGUST 1959 BEARS SOUTHERLY 50 FEET ALONG SAID WEST LINE OF ALLEY AND EASTERLY 206.50 FEET ALONG THE NORTH LINE OF SAPELLO STREET; THENCE WESTERLY 175 FEET PARALLEL TO SAID NORTH LINE OF SAPELLO STREET ALONG PROPERTY OF LOLA AND MARIA ALLRE TO FENCE CORNER AT THE SOUTHWEST CORNER OF THIS LOT ON EAST LINE OF CHAVEZ STREET; THENCE NORTHERLY 75 FEET ALONG FENCE ON THE EAST LINE OF CHAVEZ STREET TO FENCE CORNER AT THE NORTHWEST CORNER; THENCE EASTERLY 175 FEET PARALLEL TO THE NORTH LINE OF SAPELLO STREET ALONG PROPERTIES OF MARIA A. BEISRUAN, DATED MAY 27, 1970;

AND ALSO DESCRIBED AS FOLLOWS:

A PORTION OF LOT SIXTEEN (16), BLOCK I, TOWN OF LAS VEGAS, LAS VEGAS, SAN MIGUEL COUNTY, NEW MEXICO, CONTAINING 0.15 OF AN ACRE, MORE OR LESS, AS SHOWN ON PLAT OF SURVEY BY DOUGLAS J. MCFAUL, DATED JANUARY 27, 2000, FILED IN THE OFFICE OF THE SAN MIGUEL COUNTY CLERK, JAN. 31, 2000, IN PLAT BOOK 37, PAGE 86, DOCUMENT NO. 6444.

The sale is to begin at 11:45 A.M. on March 19, 2012, on the front steps of the Fourth Judicial District Court, City of Las Vegas, County of San Miguel, State of New Mexico, at which time I will sell to the highest and best bidder for cash in lawful currency of the United States of America, the Property to pay expenses of sale, and to satisfy the Judgment granted Wells Fargo Bank, NA.

Wells Fargo Bank, NA was awarded a Judgment on January 17, 2012, in the principal sum of $45,520.42, plus outstanding interest on the balance through December 13, 2011, in the amount of $2,487.54, plus escrow advance in the amount of $764.45, plus corporate advances in the amount of $265.00, less fees billed in the amount of $1,833.19, plus attorney’s fees in the sum of $900.00 and costs through January 5, 2012 in the sum of $826.79, with interest on the Judgment including late charges, property preservation fees, escrow advances, attorney’s fees and costs of this suit at the rate of 4.00% per annum from date of the entry of the Judgment until paid.

NOTICE IS FURTHER GIVEN that the real property and improvements concerned with herein will be sold subject to any and all patent reservations, easements, all recorded and unrecorded liens not foreclosed herein, and all recorded and unrecorded special assessments and taxes that may be due.  Wells Fargo Bank, NA and its attorneys disclaim all responsibility for, and the purchaser at the sale takes the property subject to, the valuation of the property by the County Assessor as real or personal property, affixture of any mobile or manufactured home to the land, deactivation of title to a mobile or manufactured home on the property, if any, environmental contamination on the property, if any, and zoning violations concerning the property, if any.

NOTICE IS FURTHER GIVEN that the purchaser at such sale shall take title to the above described real property subject to a one (1) month right of redemption.

PROSPECTIVE PURCHASERS ATSALEARE ADVISED TO MAKE THEIR OWN EXAMINATION OF THE TITLE AND THE CONDITION OF THE PROPERTY AND TO CONSULT THEIR OWN ATTORNEY BEFORE BIDDING.
