NOTICE OF SALE ON FORECLOSURE

PLEASE TAKE NOTICE that the above-entitled Court, having appointed me or my designee as Special Master in this matter with the power to sell, has ordered me to sell the real property (the “Property”) situated in Sandoval County, New Mexico, commonly known as 7284 Spruce Mountain Loop NE, Rio Rancho, NM 87144, and more particularly described as follows:

LOT NUMBERED TEN (10), IN BLOCK NUMBERED THREE (3), OF CORRALES NORTH UNIT 3, REPLAT 1, A REPLAT OF BLOCKS 1 THRU 3, A PORTION OF PARCEL “A”,  A PORTION OF WILLOW CREEK ROAD N.E., ALL OF CAPITAN COURT N.E., SPRUCE MOUNTAIN LOOP N.E., SUNLIGHT PEAK DRIVE N.E. AND A VACATION OF A PORTION OF CAPITAN COURT, CORRALES NORTH UNIT 2, CITY OF RIO RANCHO, TOWN OF ALAMEDA GRANT, SANDOVAL COUNTY, NEW MEXICO, AS THE SAME IS SHOWN AND DESIGNATED ON THE PLAT THEREOF, FILED IN THE OFFICE OF THE COUNTY CLERK OF SANDOVAL COUNTY, NEW MEXICO, ON JULY 7, 1992, IN RIO RANCHO ESTATES PLAT BOOK NO. 6, PAGES 57-58.

The sale is to begin at 9:30 A.M. on March 26, 2012, on the front steps of the Thirteenth Judicial District Court, City of Bernalillo, County of Sandoval, State of New Mexico, at which time I will sell to the highest and best bidder for cash in lawful currency of the United States of America, the Property to pay expenses of sale, and to satisfy the Judgment granted Flagstar Bank.

Flagstar Bank was awarded a Judgment on January 3, 2012, in the principal sum of $172,955.46, plus outstanding interest on the balance through December 1, 2011, in the amount of $8,431.56, plus Pro Rata MIP/PMI in the sum of $308.24, plus late charges of $533.92, plus escrow advance in the amount of $1,185.70, plus fees billed in the amount of $30.00, plus other fees due in the amount of $5.00, plus recoverable balance in the sum of $1,410.00, plus attorney’s fees in the sum of $950.00 and costs through December 12, 2011 in the sum of $741.00, with interest on the Judgment including late charges, property preservation fees, escrow advances, attorney’s fees and costs of this suit at the rate of 4.875% per annum from date of the entry of the Judgment until paid.

NOTICE IS FURTHER GIVEN that the real property and improvements concerned with herein will be sold subject to any and all patent reservations, easements, all recorded and unrecorded liens not foreclosed herein, and all recorded and unrecorded special assessments and taxes that may be due.  Flagstar Bank and its attorneys disclaim all responsibility for, and the purchaser at the sale takes the property subject to, the valuation of the property by the County Assessor as real or personal property, affixture of any mobile or manufactured home to the land, deactivation of title to a mobile or manufactured home on the property, if any, environmental contamination on the property, if any, and zoning violations concerning the property, if any.

NOTICE IS FURTHER GIVEN that the purchaser at such sale shall take title to the above described real property subject to a one (1) month right of redemption.
