NOTICE OF SALE ON FORECLOSURE

PLEASE TAKE NOTICE that the above-entitled Court, having appointed me or my designee as Special Master in this matter with the power to sell, has ordered me to sell the real property (the “Property”) situated in Otero County, New Mexico, commonly known as 216 Sierra Blanca Avenue, Tularosa, NM 88352, and more particularly described as follows:

LOT 41, SIERRA TERRACE SUBDIVISION, AND PART OFLOT42, DESCRIBED AS FOLLOWS:

BEGINNING AT THE EASTERLYLOTCORNER COMMON TO LOTS 41 AND 42 AND GOING NORTH 00° 29’ EAST A DISTANCE OF 45.55 FEET TO A POINT;

THENCE NORTH 88° 08’ WEST A DISTANCE OF 88.59 FEET TO A POINT ON THE WESTERLY LOT LINE OFLOT42;

THENCE IN A SOUTHERLY DIRECTION ALONG A CURVE WHOSE RADIUS IS 61.8 FEET A CHORD DISTANCE OF 34.96 FEET TO A POINT WHICH IS THE WESTERLY LOT CORNER COMMON TO LOTS 41 AND 42;

THENCE SOUTH 76° 35’ 30” EAST A DISTANCE OF 91.36 FEET TO THE PLACE OF BEGINNING. ALL BEING IN SIERRA TERRACE SUBDIVISION,VILLAGEOFTULAROSA,OTERO COUNTY,NEW MEXICO.

The sale is to begin at 10:15 AM. on 3/30/2012, on the front steps of the Twelfth Judicial District, City of Alamogordo, County of Otero, State of New Mexico, at which time I will sell to the highest and best bidder for cash in lawful currency of the United States of America, the Property to pay expenses of sale, and to satisfy the Judgment granted Wells Fargo Bank, NA.

Wells Fargo Bank, NA was awarded a Judgment on 1/10/2012, in the principal sum of $86,105.77, plus outstanding interest on the balance through December 6, 2011, in the amount of $4,959.16, plus late charges of 216.69, plus escrow advance in the amount of $1,478.06, plus corporate advances in the amount of $120.00,  plus attorneys fees in the sum of $950.00 and costs through January 3,2012 in the sum of 840.89, Less suspense balance in the amount of (62.16), with interest on the Judgment including late charges, property preservation fees, escrow advances, attorney’s fees and costs of this suit at the rate of 5.25% per annum from date of the entry of the Judgment until paid.

NOTICE IS FURTHER GIVEN that the real property and improvements concerned with herein will be sold subject to any and all patent reservations, easements, all recorded and unrecorded liens not foreclosed herein, and all recorded and unrecorded special assessments and taxes that may be due.  Wells Fargo Bank, NA and its attorneys disclaim all responsibility for, and the purchaser at the sale takes the property subject to, the valuation of the property by the County Assessor as real or personal property, affixture of any mobile or manufactured home to the land, deactivation of title to a mobile or manufactured home on the property, if any, environmental contamination on the property, if any, and zoning violations concerning the property, if any.

NOTICE IS FURTHER GIVEN that the purchaser at such sale shall take title to the above described real property subject to a one (1) month right of redemption.
