NOTICE OF SALE ON FORECLOSURE

PLEASE TAKE NOTICE that the above-entitled Court, having appointed me or my designee as Special Master in this matter with the power to sell, has ordered me to sell the real property (the “Property”) situated in Bernalillo County, New Mexico, commonly known as 928 Gatewood Avenue SW, Albuquerque, NM 87105, and more particularly described as follows:

A CERTAIN TRACT OF LAND DESIGNATED AS TRACT 178 A1C, IN MAP 42 OF THE MIDDLE RIO GRANDE CONSERVANCY DISTRICT, BERNALILLO COUNTY, NEW MEXICO, AND IS MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT THE NORTHWEST CORNER, A POINT ON THE WASTERLY LINE OF GATEWOOD AVENUE, S.W. (FORMERLY GURULE ROAD), WHENCE THE 1/4 CORER BETWEEN SECTIONS 24 AND 25, TOWNSHIP 10 NORTH, RANGE 2 EAST, N.M.P.M., AS SHOWN ON BERNALILLO COUNTY SURVEY SHEET NO. 2, BEARS NORTH 24”57’ WEST 2586.60 FEET DISTANT; RUNNING FROM SAID BEGINNING POINT NORTH 51”33’ EAST 154.88 FEET TO THE NORTHEAST CORNER; THENCE, SOUTH 35”43’ EAST 105.50 FEET TO THE SOUTHEAST CORNER; THENCE, SOUTH 56”49’ WEST 158.07 FEET OF THE SOUTHWEST CORNER; THENCE, NORTH 33”39 WEST ALONG THE EASTERLY LINE OF GATEWOOD AVENUE S.W. (FORMERLY GURULE ROAD) 91.20 FEET TO THE PLACE OF BEGINNING.

The sale is to begin at 9:30 AM. on March 27, 2012, on the front steps of the Second Judicial District Courthouse, City of Albuquerque, County of Bernalillo, State of New Mexico, at which time I will sell to the highest and best bidder for cash in lawful currency of the United States of America, the Property to pay expenses of sale, and to satisfy the Judgment granted Wells Fargo Bank, NA.

Wells Fargo Bank, NA was awarded a Judgment on January 4, 2012, in the principal sum of $71,004.37, plus outstanding interest on the balance through October 10, 2011, in the amount of $4,720.31, plus late charges of $184.58, plus escrow advance in the amount of $1,097.35, plus corporate advances in the amount of $120.00, plus attorneys fees in the sum of $950.00 and costs through December 28, 2011 in the sum of $850.80, with interest on the Judgment including late charges, property preservation fees, escrow advances, attorney’s fees and costs of this suit at the rate of 6.00% per annum from date of the entry of the Judgment until paid.

NOTICE IS FURTHER GIVEN that the real property and improvements concerned with herein will be sold subject to any and all patent reservations, easements, all recorded and unrecorded liens not foreclosed herein, and all recorded and unrecorded special assessments and taxes that may be due.  Wells Fargo Bank, NA and its attorneys disclaim all responsibility for, and the purchaser at the sale takes the property subject to, the valuation of the property by the County Assessor as real or personal property, affixture of any mobile or manufactured home to the land, deactivation of title to a mobile or manufactured home on the property, if any, environmental contamination on the property, if any, and zoning violations concerning the property, if any.

NOTICE IS FURTHER GIVEN that the purchaser at such sale shall take title to the above described real property subject to a one (1) month right of redemption.
