ORDER SETTING DATE FOR HEARING ON PETITION OF AN HEIR FOR ADJUDICATION OF INTESTACY AND APPOINTMENT OF PERSONAL REPRESENTATIVE
This cause coming on for hearing before the Court on the Petition of PETER H. JOHNSTONE, a third party who has been asked by the natural guardian of MARSHALL DAVID MONTNER, who is decedent DAVID K. MONTNER’S only heir, to fix a date for hearing on his Petition of an Heir for Adjudication of Intestacy and Appointment of Personal Representative.
IT IS, THEREFORE, ORDERED that the 5th day of April, 2012, at 9:50 A.M. be, and it hereby is, fixed as the time for hearing objections, if any, to said Petition of an Heir for Adjudication of Intestacy and Appointment of Personal Representative, and that at such time the Court, in the Office of the District Judge at the Courthouse in Albuquerque, Bernalillo County, New Mexico, will examine the Petition Of An Heir For Adjudication Of Intestacy And Appointment Of Personal Representative, approve the same, if found to be correct, enter its Order determining the heirs of the decedent, formally appointing PETER H. JOHNSTONE as Personal Representative of the Estate of said decedent, and ordering Letters of Administration to be issued to PETER H. JOHNSTONE upon qualification and acceptance.
