RESOLUTION

AMENDING THE NORTH 1-25 SECTOR DEVELOPMENT PLAN TO INCLUDE A REVISED DEFINITION OF SU-2/MUD ZONING AND TO INCLUDE THE CORONADO VILLAGE MOBILE HOME PARK SITE IN THE LAND USE DISTRICT OVERLAY MAP AND TO AMEND THE SU-2/MUD ZONING DEVELOPMENT STANDARDS.

WHEREAS, the Council, the Governing Body of the City of Albuquerque, has the authority to adopt and amend plans for the physical development of areas within the planning and platting jurisdiction of the City authorized by statute, Sections 3-19-1 through 3-19-12 NMSA 1978 and by its home rule powers: and

WHEREAS, on February 17, 2010 the Albuquerque City Council repealed the 1986 North I-25 Sector Development Plan and adopted the Revised North I-25 Sector Development Plan through Council Resolution R-09-263, Enactment Number R-2010-041; and

WHEREAS, the Council has the authority to adopt, amend, or repeal such a sector development plan; and

WHEREAS, the City Council found approval of the Revised North I-25 Sector Development Plan consistent with applicable goals and policies of the Comprehensive Plan, Planned Growth Strategy, the North Valley Area Plan, Major Public Open Space Facility Plan, Facility Plan for Arroyos, Trails & Bikeways Facility Plan, the Alameda Boulevard Design Overlay Zone and R-270-1980; and

WHEREAS, the owner of Coronado Village Mobile Home Park (Coronado Village) has appealed the decision of the City Council to exclude the property of Coronado Village from the Land Use District Overlay afforded by the Plan; and

WHEREAS, the Second Judicial District Court of the State of New Mexico has remanded this action to the City Council for consideration of inclusion of Coronado Village’s property into the Land Use District Overlay as presented by the Plan, and the Court also has asked that the City Council consider amending the zoning development standards for Coronado Village to those of the original 1986 North I-25 Sector Development Plan; and

WHEREAS, it is advantageous to the community as articulated in the Albuquerque Bernalillo Comprehensive Plan and the goals of the North I-25 Sector Plan to include the Coronado Village site, which is located at the northwest corner of Interstate I-25 and Paseo del Norte, in the Regional Commercial Land Use District Overlay presented in the Plan because the Regional Commercial Land Use District allows for a mix of multi-family and non-residential uses, and the Coronado Village site is a node of development similar to other parcels located within the Plan area that are designated as Regional Commercial.
