NOTICE OF SALE

NOTICE is hereby given that on July 2, 2012, at 10:00 a.m., the undersigned Special Master will sell to the highest bidder at the front door of the Second Judicial District Courthouse, 4th and Lomas, Albuquerque, NM 87102, all Defendants’ interest in the real property located at 1016 Goff Blvd. SW, Albuquerque, NM 87102, in Bernalillo County, New Mexico, and more particularly described as:

TRACT NUMBERED NINE (9) OF THE VIVIAN PLACE ADDITION, AN ADDITION TO THE CITY OF ALBUQUERQUE, NEW MEXICO, AS THE SAME IS SHOWN AND DESIGNATED ON THE PLAT AND DEDICATION THEREOF, FILED IN THE OFFICE OF THE COUNTY CLERK AND EX-OFFICIO RECORDER OF BERNALILLO COUNTY, NEW MEXICO, ON DECEMBER 19, 1945, IN VOLUME B1, FOLIO 88.

WITH MORTGAGE COVENANTS.

The sale will satisfy all or a portion of a Default Judgment and Stipulated Judgment, Decree of Foreclosure, Order of Sale, and Appointment of Special Master entered on April 26, 2012, as follows:

A. Judgment against Defendant Joseph Francis Rosales, Jr. in the amount of $41,241.56, with interest accruing at 6.740% per day from December 6, 2011, forward; and

B. In rem judgment against Defendants Irene G. Rosales, individually, Daniel Rosales, as Trustee of the Irene G. Rosales Revocable Trust dated September 12, 2008, New Mexico Bonding, LLC, f/k/a New Mexico Bail Bonds, InfiBank, N.A., and HSBC Bank Nevada, N.A. removing all interests of said defendants in the subject property.

The Default Judgment and Stipulated Judgment, Decree of Foreclosure, Order of Sale, and Appointment of Special Master may be obtained from either the court clerk or the undersigned Special Master prior to the sale date.  BOKF N.A. d/b/a Bank ofAlbuquerque, successor by merger to Bank of Albuquerque, N.A. has the right to bid at the sale and to apply its judgment or a portion thereof to the purchase price in lieu of cash.  For all other bidders, the sale terms are cash or its equivalent by the close of business on the day of sale.  The sale may be postponed and rescheduled at the Special Master’s discretion.
