NOTICE OF HEARING BY PUBLICATION
THE STATE OF NEW MEXICO:
TO: ALL PERSONS WHO HAVE OR CLAIM ANY INTEREST IN THE ESTATE OF RUSSELL M. ERVIN, JR., DECEASED, OR IN THE MATTER BEING LITIGATED IN THE HEREINAFTER MENTIONED HEARING.
A hearing on the Petition for Formal Probate of Will, Determination of Heirship, and Order of Complete Settlement of Estate by Personal Representative (the“Petition”) filed by LeeAnn Ortiz, Personal Representative, will be held at the Bernalillo County District Courthouse, 400 Lomas, NW, Albuquerque, NM, on July 5, 2012, at 1:30 p.m., before the Honorable Nan G. Nash, District Judge, with ten (10) minutes allocated for the hearing. You are hereby notified that at the hearing the Court will consider the request by the petitioner that:
1. The Court approve the Final Account attached to the Petition as Exhibit A.
2. The Court approve the distribution of the estate as shown on the Schedule of Distribution attached to the Petition as Exhibit B.
3. The Court confirm its prior informal order entered on July 20, 2009, by entering a formal order probating decedent’s Will dated February 26, 2003, and determining the heirs and devisees of decedent’s estate.
4. The Court declare the estate fully settled and discharge petitioner from further claims or demand of any interested person.
A copy of the Petition is on file with the Court in the above-captioned cause and is available for your review.
Pursuant to 45-1-401 NMSA 1978, notice of the time and place of hearing on the Petition is hereby given you by publication, once each week, for two consecutive weeks.
