NOTICE OF SALE

NOTICE IS HEREBY GIVEN that the undersigned Special Master will on Friday, September 28, 2012 at 10:00 a.m.be at the Bernalillo County Courthouse, 400 Lomas Boulevard NW, Albuquerque, New Mexico to sell and convey to the highest bidder for cash all right, title and interest of the above-named Defendants in and to the following real estate located in said County and state, which is commonly known as 1704 Algodones NE, Albuquerque, New Mexico, and which is more particularly described as follows:

LOT NUMBERED TWO (2) IN BLOCK NUMBERED FOUR (4) OF THE JUAN TABO ADDITION TO THE CITY OF ALBUQUERQUE, NEW MEXICO, AS THE SAME IS SHOWN AND DESIGNATED ON THE PLAT OF SAID ADDITION FILED IN THE OFFICE OF THE COUNTY CLERK OF BERNALILLO COUNTY, NEW MEXICO, ON JULY 8, 1952.

Said sale shall be made pursuant to the Stipulated and Default Judgment, Decree of Foreclosure, Order of Sale and Appointment of Special Master entered on January 14, 2011 in the above-numbered cause, which was a suit to foreclose a real estate mortgage held by the above Plaintiffs and wherein the Plaintiffs were adjudged to have a first and paramount lien against the above-described real estate in the amount of $152,578.04, plus interest to the date of sale, and a Special Master’s fee, the total amount due and owing as of the date of sale being $ 176,755.80.

NOTICE IS FURTHER GIVEN that the real property and improvements concerned with herein will be sold subject to any and all patent reservations, easements, all recorded and unrecorded special assessments and taxes that may be due.

NOTICE IS FINALLY GIVEN that should the Plaintiffs and/or Defendants herein bid and/or become purchasers of said real estate and improvements at the foreclosure sale, they may use any part of their Judgment granted herein and heretofore as credit against the purchase price should they be the highest bidder.  From all other parties, the Special Master will accept only cash in payment of a bid, or a bank cashier’s check, or a satisfactory Letter of Credit conditioned that the Special Master receives cash or certified funds by 3:00 p.m. on the day of the foreclosure sale.

The sale may be postponed and rescheduled at the discretion of the Special Master or her designee.
