NOTICE OF SALE

Notice is hereby given that the undersigned Special Master will, on the 13th day of Sep-tember, 2012, at 10:00 a.m., at the main entrance of the Guadalupe County Court-house, Santa Rosa, New Mexico, sell and convey to the highest bidder for cash at the time of the sale all the right, title and interest of the above-named Defendants in and to the following described real estate: the Sun ?n Sand Motel, at 1120 Historic Route 66, Santa Rosa, NM 88435, which is more particularly described as:

1.675 acres, more or less, being all of Lots Thirteen (13) and Fourteen (14), and portion of Lots One (1), Two (2), Three (3), Four (4), Eight (8), Nine (9), Ten (10), Eleven (11), Twelve (12), Fifteen (15) and Sixteen (16) and of the va-cated alleyways, Block Forty-five (45) of the Original Town-site of Santa Rosa, Guadalupe County, New Mexico, as shown on plat of survey by Lydick Engineers & Surveyors, dated May, 2006, plat no. 18758, filed in the office of the Guadalupe County Clerk, May 24, 2006 in Plat Book C, page 126.

The sale will be made pursuant to the Default Judgment, Decree Of Foreclosure, Order Of Sale And Appointment Of Special Master entered on July 25, 2012, in the above-entitled and numbered cause, which was a suit for judgment on a promissory note and foreclosure of a mortgage lien held by Plaintiff and in which Plaintiff was granted judg-ment and has a lien against the above-described real estate in the amount of $435,445.68, plus interest at the per diem accrual of $84.60 from the date of Judgment to the date of confirmation of the sale, plus additional costs and attorney’s fees neces-sary to protect the real estate, together with costs of sale including a reasonable Special Master’s fee. Plaintiff has the right to submit a bid verbally or in writing. Plaintiff may ap-ply all or any part of its judgment to the purchase price in lieu of cash. At the date and time stated above, and at the discretion of the Special Master, the sale may be post-poned and re-scheduled without the necessity of publishing a new notice of sale.

Notice is further given that the real property will be sold subject to any and all patent reservations, easements, all recorded and unrecorded liens not foreclosed herein, and all recorded and unrecorded special assessments and taxes that may be due. Plaintiff and its attorneys disclaim all responsibility for, and the purchaser at the sale takes the property subject to, the valuation of the property by the county assessor as real or per-sonal property, affixture of any mobile or manufactured home to the land, deactivation of title to a mobile or manufactured home on the property, if any, environmental contami-nation on the property, if any, and zoning violations concerning the property, if any.

Notice is further given that this sale may be subject to a bankruptcy filing, a pay off, a reinstatement or any other condition that would cause the cancellation of this sale. Fur-ther, if any of these conditions exist, this sale will be null and void. The successful bid-der’s funds shall be returned, and the Special Master and Plaintiff shall not be liable to the successful bidder for any damages.

Notice is further given that the purchaser at such sale shall take title to the above de-scribed real property subject to any rights of redemption provided by applicable law.
