NOTICE OF HEARING ON PETITION FOR ORDER OF FORMAL PROBATE OF WILL, DETERMINATION OF HEIRSHIP AND CONFIRMATION OF PREVIOUS INFORMAL APPOINTMENT OF PERSONAL REPRESENTATIVE
THE STATE OF NEW MEXICO TO:
Nancy Nowicki, Marie Hochrein, Aneeda Abeyta, Joel Rogers, Brad Killman, Jeff Killman,Carmen Chavez and Sam Chavez;
THE FOLLOWING KNOWN PERSONS WHOSE ADDRESSES OR IDENTITIES ARE UNKNOWN: (NONE KNOWN); and
ALL UNKNOWN HEIRS OF LUGARDA DURAN ABEYTA, DECEASED, AND ALL UNKNOWN PERSONS CLAIMING ANY INTEREST IN THE ESTATE OF LUGARDA DURAN ABEYTA, DECEASED OR HAVING ANY INTEREST IN THE MATTERS BEING LITIGATED
Brad Killman, the undersigned Petitioner, has filed a Petition for Order of Formal Probate of Will, Determination of Heirship and Confirmation of Previous Informal Appointment of Personal Representative, which alleges that LUGARDA DURAN ABEYTA died on August 19, 2012 at the age of 92 years, domiciled in Bernalillo County, New Mexico, and leaving as her surviving heirs and devisees the persons named above.
The Petition further alleges that Decedent left a Last Will and Testament executed on September 11, 2006 and a Codicil to such Last Will and Testament dated February 8, 2007.
The Petition requests a judicial order of formal probate of the Will and Codicil thereto referred to above, a formal determination of Decedent’s heirs, formal confirmation of the previous informal appointment of Petitioner to serve as Personal Representative of Decedent’s Will, Codicil thereto and Estate without bond or other security, and confirmation of the previous issuance of Letters Testamentary to Petitioner.
Pursuant to Sections 45-1-401 and 45-3-403 NMSA (1978 Comp.), you are hereby notified that a hearing to consider the Petition has been set at the Bernalillo County District Court, Bernalillo County Courthouse, in Albuquerque, New Mexico on Januay 15, 2013 at 9:30 a.m. before the Honorable Denise Barela Shepherd, District Judge.
