NOTICE OF SALE ON FORECLOSURE
PLEASE TAKE NOTICE that the above-entitled Court, having appointed me, or my designee, Special Master of this matter with the power to sell, has ordered me to sell the real property situated in Bernalillo County, State of New Mexico, described as follows:
Lot numbered Twenty-Six (26) in Block numbered Six (6) of Dale J. Bellamah’s Princess Jeanne Park, an addition to the City of Albuquerque, New Mexico, as shown and designated on the Plat of Blocks 1-14 inclusive of said addition filed in the office of the County Clerk of Bernalillo County, New Mexico, on June 15, 1954.
The street address of said real property is 10413 Bellamah Avenue NE, Albuquerque, New Mexico 87113.
The Judgment, Decree of Foreclosure, Order of Sale and Appointment of Special Master was rendered in the above-entitled and numbered cause on February 25, 2013. The nature of the above-entitled and numbered cause was to foreclose a Mortgage on the above-described property.
The sale is to begin at 10:00 a.m., on April 9, 2013, outside the front entrance of the Bernalillo County Courthouse, City of Albuquerque, State of New Mexico, at which time I will sell to the highest bidder for cash in the lawful currency of the United States of America, the property to pay expenses of sale, and to satisfy the judgment entered in the above-entitled action as follows:
a. in favor of HANK HARENBERG on the Note dated July 1, 2012, in the principal amount of $3,000.00 plus $250.68 in unpaid interest, plus unpaid late charges of $100.00 for a total amount of $3,350.68 plus interest from January 21, 2013 at the rate of $2.05 per day; and
b. in favor of EQUITY TRUST CO. on the Notes dated dated April 18, 2012, and May 15, 2012, in the total principal amount of $40,000.00 plus $5,222.00 in unpaid interest, plus unpaid late charges of $200.00 for a total amount of $45,422.00 plus interest from January 21, 2013 at the rate of $27.39 per day; and
c. in favor of the Plaintiffs in proportion to their claims the amount of $430.85 for delinquent water and sewer charges, plus $10,282.06 in unpaid real estate taxes due and payable as of December 10, 2012, plus Plaintiff’s reasonable costs, attorneys fees and taxes incurred herein in the amount of $7,590.14 for a total judgment of $66,875.73 plus interest from January 21, 2013 as stated amounts above plus a special master’s fee of $250.00 plus tax, plus all costs of sale.
Plaintiffs are allowed to bid the amount of their Judgment, or any portion thereof, at said sale as the equivalent of cash.
