NOTICE is hereby given that on August 29, 2013, at 9:30 a.m., the undersigned Special Master or his agent will sell to the highest bidder at the entrance of Second Judicial Courthouse, located at 400 Lomas Blvd, Albuquerque, NM 87102, all Defendants’ interest in the real property located at 300 Tijeras Avenue NE, #317, Albuquerque, New Mexico, and more particularly described as:
UNIT NUMBERED THREE HUNDRED SEVENTEEN (317) OF THE GYM LOFTS CONDOMINIUM AS ESTABLISHED BY THAT CERTAIN DECLARATION OF GYM LOFTS CONDOMINIUM RECORDED MAY 5, 2005 IN BOOK A96, PAGE 3049 AS DOCUMENT NO. 2005063533 AND RE-RECORDED MAY 16, 2005 IN BOOK A96, PAGE 7425 AS DOCUMENT NO. 2005067628, RECORDS OF BERNALILLO COUNTY, NEW MEXICO AND THE CONDOMINIUM PLAT OF GYM LOFTS CONDOMINIUM, TRACT A-6, BANNER SQUARE ADDITION, SECTION 20, T.10N., R.3E., N.M.P.M., CITY OF ALBUQUERQUE, BERNALILLO COUNTY, NEW MEXICO, AS THE SAME IS SHOWN AND DESIGNATED ON THE PLAT THEREOF, FILED IN THE OFFICE OF THE COUNTY CLERK OF BERNALILLO COUNTY, NEW MEXICO, ON MAY 6, 2005 IN BOOK A96, PAGE 3150 AS DOCUMENT NO. 200506334; TOGETHER WITH AN UNDIVIDED PERCENTAGE INTEREST IN THE COMMON ELEMENTS APPURTENANT TO SAID UNIT
The sale will satisfy all or a portion of a Default Judgment entered on May 28, 2013, in the amount of $167,627.84, with interest accruing at 5.625% per year from September 29, 2012, forward.
The Judgment may be obtained from either the court clerk or the undersigned Special Master prior to the sale date. Bank of America, N.A., its successor, investor, or assignee has the right to bid at the sale and to apply its judgment or a portion thereof to the purchase price in lieu of cash. For all other bidders, the sale terms are cash or its equivalent by the close of business on the day of sale. The sale may be postponed and rescheduled at the Special Master’s discretion.
PROSPECTIVE PURCHASERS AT SALE ARE ADVISED TO MAKE THEIR OWN EXAMINATION OF THE TITLE AND THE CONDITION OF THE PROPERTY AND TO CONSULT THEIR OWN ATTORNEY BEFORE BIDDING.
