NOTICE OF SALE ON FORECLOSURE
PLEASE TAKE NOTICE that the above-entitled Court, having appointed me as Special Master in this matter with the power to sell, has ordered me to sell the real property (“Property”) situated in Bernalillo County, New Mexico, commonly known as 4532 Silver Arrow Drive NW, Albuquerque, New Mexico 87114, and more particularly-described as follows:
Lot numbered Fifty-four-P1 (54-P1) of EAGLE RIDGE SUBDIVISION, UNIT 2, PHASE 2, a Subdivision in the City of Albuquerque, Bernalillo County, New Mexico, as the same is shown and designated on the plat of said land, filed in the Office of the County Clerk of Bernalillo County, New Mexico, on February 11, 1994, in Plat Book 94-C, folio 47.
The sale is to begin at 10:00 a.m. on September 12, 2013 outside the front entrance of the Bernalillo County Courthouse, 400 Lomas Boulevard NW, Albuquerque, NM 87102, at which time I will sell to the highest and best bidder for cash in lawful currency of the United States of America the Property to pay any expenses of sale, and to satisfy the Judgment granted Plaintiff on August 1, 2013, in the principal amount of $42,321.09, plus interest in the amount of $16,658.21 as of March 1, 2013, plus interest accruing thereafter at the rate of 10.050% per annum, or $11.65 per day, plus late charges of $972.90, plus title report fees of $240.75, plus attorney’s fees and costs of $1,100.00, plus special master’s fees and all other costs of foreclosure sale, plus post-judgment interest at the rate of 10.050% per annum from the date of judgment until paid.
NOTICE IS FURTHER GIVEN that the real property and improvements concerned with herein will be sold subject to any and all patent reservations, easements, all recorded and unrecorded liens not foreclosed herein, and all recorded and unrecorded special assessments and taxes that may be due. Plaintiff and its attorneys disclaim all responsibility for, and the purchaser at the sale takes the property subject to, the valuation of the property by the County Assessor as real or personal property, affixture of any mobile or manufactured home to the land, deactivation of title to a mobile or manufactured home on the property, if any, environmental contamination on the property, if any, and zoning violations concerning the property, if any.
The sale is subject to a one (1) month right of redemption in favor of Defendants Bernadette M. Dominguez and Vincent P. Dominguez and the prior mortgage interest in the Property in favor of Argent Mortgage Company, LLC as set forth in the Judgment.
