AMENDED NOTICE OF SALE
AMENDED NOTICE is hereby given that on October 9, 2013, at 9:30 a.m., the undersigned Special Master or his agent will sell to the highest bidder at the entrance of the Bernalillo County Courthouse, 400 Lomas Blvd, Albuquerque, NM 87102, all Defendants’ interest in the real property located at 8615 Southwest Robby, Albuquerque, New Mexico 87121-7942 in Bernalillo County, and more particularly described as:
LOT NUMBERED FOURTEEN (14) IN BLOCK NUMBERED SEVENTY-FIVE (75) OF WESTGATE HEIGHTS UNIT NO. 3, AN ADDITION TO THE CITY OF ALBUQUERQUE, NEW MEXICO, AS THE SAME IS SHOWN AND DESIGNATED ON THE PLAT OF SAID ADDITION, FILED IN THE OFFICE OF THE COUNTY CLERK OF BERNALILLO COUNTY, NEW MEXICO, ON APRIL 22, 1977, IN MAP BOOK D7, FOLIO 167.
TOGETHER WITH all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. All replacements and additions shall also be covered by this Security Instrument. All of the foregoing is referred to in this Security Instrument as the “Property.”
The sale will satisfy all or a portion of a Default Judgment entered on August 14, 2013, in the amount of $128,227.77, with interest accruing at 6.375% per year from May 7, 2013, forward.
The Default Judgment may be obtained from either the court clerk or the undersigned Special Master prior to the sale date. Bank of America, N.A. or its assignee or successor-in-interest has the right to bid at the sale and to apply its judgment or a portion thereof to the purchase price in lieu of cash. For all other bidders, the sale terms are cash or its equivalent by the close of business on the day of sale. The sale may be postponed and rescheduled at the Special Master’s discretion.
PROSPECTIVE PURCHASERS AT SALE ARE ADVISED TO MAKE THEIR OWN EXAMINATION OF THE TITLE AND THE CONDITION OF THE PROPERTY AND TO CONSULT THEIR OWN ATTORNEY BEFORE BIDDING.
