NOTICE OF SPECIAL MASTER’S SALE
NOTICE IS HEREBY GIVEN that the undersigned Special Master will on the 7th day of
January 2015, at 9:30 a.m., just outside the front door of the main entrance to the Bernalillo
County Courthouse, 400 Lomas NW, Albuquerque, NM, sell and convey all of the right, title and interest of the parties in the above-entitled action in and to the below described real property:
Lot numbered eighty nine (89) in the Torrey Pines Subdivision of the Tanoan Community Association, an addition to the City of Albuquerque, Bernalillo County, New Mexico, as the same is shown and designated on the Plat thereof, filed in the office of the County Clerk of Bernalillo County, New Mexico, on September 27, 1979 (commonly known as 9333 Ironshore NE, Albuquerque, New Mexico).
together with all structures and improvements thereon.
The Property will be sold at the Special Master’s Sale “AS IS,” and “WHEREAS” without
warranties, express or implied. The sale shall be subject to the first mortgage in favor of Colonial Savings, F.A. (“Colonial”) and any unpaid taxes.
The Special Master’s Sale is being made pursuant to the Judgment For Money Due Against
Defendant Becky Ellis and For Foreclosure (the “Judgment”) entered in the above-entitled cause on September 3, 2014 in favor of Tanoan Community Association, Inc. (“Tanoan”). The mortgage of Colonial has been adjudicated to be a first priority mortgage and the foreclosure sale shall be subject to the first mortgage of Colonial.
The lien of Tanoan secures a judgment against Ellis in the amount of Three Thousand Two
Hundred Fifty Eight Dollars and Forty Four Cents ($3,258.44) as of September 3, 2013 with
interest accruing on that amount at the rate of 8.75% per annum.
As of the date of the Special Master’s Sale the total amount of Tanoan’s Judgment will be
$3,642.76. Said sum does not include the costs, expenses and fees of the Special Master (estimated to be approximately $350.00, including the cost of publication).
The Property will be sold to the highest bidder for cash in lawful currency of the United
States of America. In payment of a bid, the Special Master will accept only cash or a cashier’s check issued by a federally chartered and insured credit union or bank, or a New Mexico State chartered and federally insured credit union or bank. If paid by cashier’s check the bid must be paid with immediately available and collectible federal funds, subject to verification by the Special Master. The cash or cashier’s check from the successful bidder must be received by the Special Master no later than 3:00 p.m. on the date of the Special Master’s Sale.
Tanoan may bid and purchase the Property at the Special Master’s Sale, and may bid in and
use all or a portion of Tanoan’s Judgment in lieu of cash or certified funds towards the purchase price.
Proceeds of the Special Master’s Sale will be distributed first to the Special Master to satisfy
his fees, costs and expenses, and then pursuant to the Judgment entered in this matter.
