NOTICE is hereby given that on January 15, 2015, at 1:30 p.m., the undersigned Special Master or his agent will sell to the highest bidder at the entrance of the Second Judicial District Courthouse, 400 Lomas Blvd, Albuquerque, NM 87102 all Defendants’ interest in the real property located at 9927 Edith Blvd NE, Albuquerque, New Mexico 87113, Bernalillo County, New Mexico, and is more particularly described as follows:
A TRACT OF LAND SITUATE IN SECTIONS 10 AND 11 TOWNSHIP 11 NORTH, RANGE 3 EAST, N.M.P.M., BERNALILLO COUNTY, NEW MEXICO, BEING AND COMPRISING THE EASTERLY PORTION OF TRACT 163-B-2-B AS THE SAME IS SHOWN AND DESIGNATED ON THE MIDDLE RIO GRANDE CONSERVANCY DISTRICT PROPERTY MAP NO. 23 AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHEAST CORNER TO THE TRACT HEREIN SET FORTH, A POINT ON THE WESTERLY RIGHT-OF-WAY LINE OF EDITH BOULEVARD N.E. (NEW MEXICO PROJECT NO, S-271 (1). WHENCE THE SECTION CORNER COMMON TO SECTIONS 10, 11, 14 AND 15, TOWNSHIP 11 NORTH, RANGE 3 EAST, N.M.P.M., BEARS SOUTH 03 DEG. 35’ 10” WEST, 1038.40 FEET DISTANT; AND RUNNING; THENCE NORTH 71 DEG. 45’ 15” WEST, 121.50 FEET TO THE SOUTHWEST CORNER OF THE TRACT HEREIN SET FORTH; THENCE NORTH 18 DEG. 35’ 00” EAST, 61.72 FEET TO A POINT ON THE SOUTHERLY RIGHT-OF-WAY LINE OF ALAMEDA ROAD NE AND THE NORTHWEST CORNER OF THE TRACT HEREIN SET FORTH; THENCE SOUTH 70 DEG. 42’ 20” EAST, 111.80 FEET ALONG SAID SOUTHERLY RIGHT-OF-WAY LINE OF ALAMEDA ROAD NE AND THE NORTHWEST RIGHT-OF-WAY LINE OF SAID EDITH BOULEVARD NE AND THE NORTHEAST CORNER OF THE TRACT HEREIN SET FORTH; THENCE; SOUTH 09° 20’ 20” WEST, 60.40 FEET TO THE SOUTHEAST CORNER AND PLACE OF BEGINNING.
TOGETHER WITH all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. All replacements and additions shall also be covered by this Security Instrument. All of the foregoing is referred to in this Security Instrument as the “Property.”
The sale will satisfy all or a portion of the In Rem Judgment entered on November 26, 2014, in the amount of $127,105.36, with interest accruing at 4.375% per year from 170,754.98, forward.
The Judgment may be obtained from either the court clerk or the undersigned Special Master prior to the sale date. NRZ Pass-Through Trust I, U.S. Bank, National Association, as Trustee, its successor, investor, or assignee have the right to bid at the sale and to apply their judgments or a portion thereof to the purchase price in lieu of cash. For all other bidders, the sale terms are cash or its equivalent by the close of business on the day of sale. The sale may be postponed and rescheduled at the Special Master’s discretion.
PROSPECTIVE PURCHASERS AT SALE ARE ADVISED TO MAKE THEIR OWN EXAMINATION OF THE TITLE AND THE CONDITION OF THE PROPERTY AND TO CONSULT THEIR OWN ATTORNEY BEFORE BIDDING.
