THAT Spectrum Paseo, LLC, is the landlord of a certain Business Premises Lease dated April 21, 2005, originally between Los Angeles Avenue Associates, a partnership, and Grace Enterprises, Inc., Keith D. Gilbert and Catherine L. Gilbert as Tenants for the premises known as 4521-4525 Paseo del Norte NE, Units W-Y, Albuquerque, New Mexico.
On January 20, 2015, Landlord sent to the above Tenants at the above address a certain Notice to Quit (Eviction Notice- Commercial) Notice of Claim of Land-lord’s Lien/Notice Regarding Secured Collateral. As of the date of the said Notice, the rental arrears demanded was $104,987.22. Base Rent in the amount of $6,490.00 plus taxes and insurance is due monthly on the first day of the month. There is a security deposit of $6,904.00. More than ten (10) days after said Notice, the Landlord retook the premises.
The property purportedly belonging to the Tenants that remained in or about the premises at the time Landlord retook the premises consists of:
a. Miscellaneous tangible personal property including: one (l) Hyster forklift Serial No. C187V133055, and, (2) one (1) American Security safe with Cascade series lock, 72”H X 40”W X 26”D.
b. The following motor vehicles and trailers registered in New Mexico:

The above property is being stored in the rear portion of the premises in order to place the premises into leasable condition; and, it may be viewed upon request to the undersigned.
Accordingly, pursuant to NMSA 1978, §48-3-14 (1997) you are hereby notified that: the above property will be sold at public auction to the highest bidder for cash at 4521-4525 Paseo del Norte NE, units W-Y, Albuquerque, New Mexico, at 10:00 a.m. on Wednesday April 22, 2015.
