ORDER  FOR  SERVICE BY PUBLICATION

THIS MATTER, having come before the Court on the 29th day of January, 2016 and the court having been fully advised, Petitioner Nadia Luna, by and through her counsel of record, Rudolph B. Chavez, Esq., and respectfully requests an Order requiring Respondent, Jose Steve Luna, to appear or plead in the above-entitled and numbered cause within (15) days after publication of this Order in a newspaper of general circulation, The Health City Sun, in the county of Bernalillo, New Mexico where the case is pending and the Court has been fully advised and the premises finds:

1)       The Respondent,  Jose  Steve Luna has been  absent from the jurisdiction  of the court

since 1995.

2)            The Respondent  cannot be properly  served by process with the State of New  Mexico.

3)            This Court has personal jurisdiction  over the subject matter .

4)            The Marriage should be dissolved between parties.

IT IS THEREFORE ORDERED JUDGED AND DECREED that:

1)            The Petitioner, Nadia Luna, shall publish this Order not less than once a week for six consecutive weeks in a newspaper  of general  circulation, The Health  City Sun

in the county  of Bernalillo, New Mexico where the action is   pending.

2)            Respondent, Jose Steve Luna, shall appear or plead within (15) days after publication of this Order in a newspaper of general circulation, The Health City Sun in the county of Bernalillo, New Mexico where the case is pending in accordance with this court.

3)            The Respondent, Jose Steve Luna, shall be deemed served by Publication  and if he fails to appear and/or answer within the time allowed and the Court shall proceed  as if absent.

4)            Should the Respondent, Jose Steve Luna not appear, the Court will proceed to Dissolve the Marriage.
