This matter came before the Special Commissioner on June 29, 2016, on the Petitioner’s / Respondent’s
Motion to Extend the Protection Order.
The Special Commissioner having reviewed the Motion, enters the following Findings and Recommendations:
[x] The Respondent has not been properly served with the Motion to extend the custody attachment to the Order of Protection. There is an open domestic matters case (DM 2015-3417). Based on the Motion filed by Petitioner in DM 2015-3417 Petitioner does not know where Respondent is located at this time. Counsel for Respondent has withdrawn as legal counsel. This court will extend the custody attachment until the hearing set below to allow Petitioner time to either locate Respondent and have him personally served or request and serve Respondent by publication. Petitioner’s Motion to extend custody attachment shall be heard before Special Commissioner D. Sais at 400 Lomas Blvd on September 1, 2016 at 1:30 (pm) for 30 minutes (time allotted).
