THIS MATTER having come before the Court upon the Motion of Petitioner Alyssa A. Morris, by and through her counsel Bernard Rosenblum, and the Court being well advised in the premises, FINDS:
1. That an investigation of the identity and/ or whereabouts of the father of the minor child herein has been made pursuant to section 40-7-44 NMSA 1978 as amended.
2. That after conduct of that investigation, information as to the identity and/or whereabouts of the father of the minor child herein is still insufficient to effect service in accordance with the Rule 4 (e) or 4(k).
3. That the only possible means of notice of pendency of the Petition To Establish Paternity, To Set Child Support and Determine Custody and Emergency Motion for Temporary Sole Custody herein upon the unknown father of the minor child is by service by Publication.
4. IT IS THEREUPON ADJUDGED, ORDERED AND DECREED that notice of pendency of the Petition To Establish Paternity, To Set Child Support and Determine Custody and Emergency Motion for Temporary Sole Custody herein be made by publication as to the father of the minor child.
