NOTICE TO BIRTH FATHER
ARIZONA REVISED STATUTE §8-106(G)
TO: DANIEL ROMERO;
Pursuant to A.R.S. §8-106(G), notice is given to DANIEL ROMERO, that you have been identified by ASHLEY BARRERAS, residing in Tolleson, Arizona, as the potential father of Unborn Baby Barreras, due to be born on or about March 18, 2018.
You, DANIEL ROMERO, have been named the potential biological father of this child. You are informed of the following:
1. The natural mother, ASHLEY BARRERAS, is planning on placing her child for adoption through Adoption Choices of Arizona.
2. Under Arizona law, A.R.S. §8-106 and A.R.S. §8-107 you have the right, if you are the biological father of this child, to consent or withhold your consent to the proposed adoption.
3. A copy of A.R.S. §8-106 is attached to this Notice.
4. Your written consent to the adoption is irrevocable once you sign it.
5. You have the right to seek custody of the child.
6. In the event that you wish to assert parental rights to the child described above, and/or if you wish to withhold your consent to the proposed adoption plan, your obligations are as follows:
A. If paternity has not been established, you must initiate a paternity action, under Title 25, Chapter 6, Title 1, Arizona Revised Statutes and serve upon the mother the paternity action within thirty (30) days of completion of service of this Notice.
B. You have the obligation to proceed to judgment in the paternity action.
6. Once paternity is established, you must begin providing financial support for the child, and if paternity is not established until after the child is born, you may be responsible for past support. [A.R.S. §25-809(A)]
7. If you do not file a paternity action and do not serve upon the mother your paternity action within thirty (30) days after completion of service of this Notice and pursue the action to judgment, you cannot bring or maintain any action to assert any interest in the child.
8. The Indian Child Welfare Act may supersede the Arizona Revised Statutes regarding this adoption and paternity, if applicable to this adoption.
9. For purposes of service of a paternity action, service may be made on the mother by serving Adoption Choices of Arizona c/o Philip (Jay) McCarthy, Jr., Esq., McCarthyWeston, PLLC, 508 North Humphreys Street, Flagstaff, Arizona 86001.
