PETITIONERS’ APPLICATION FOR ORDER
DETERMINING CHILD ELIGIBLE FOR ADOPTION
WITHOUT THE CONSENT OF HIS LEGAL FATHER

PLEASE TAKE NOTICE that, on the 6th day of April, 2018, a Petition for Adoption (“Petition for Adoption”) was filed in this Court for the relative adoption of Robert Steven Bissell, Jr., a male Pacific Islander/Mexican/Caucasian child born on June 14, 2010, at St. John Medical Center, Tulsa, Tulsa County, Oklahoma.
TAKE FURTHER NOTICE that, on the 3rd day of October, 2018, an Application for an Order determining the Child eligible for adoption without the consent of his legal father (“AWOC Application”) was filed to allow the adoption of the Child without your consent.
TAKE FURTHER NOTICE that the AWOC Application asking the Court to allow the adoption of the Child without your consent is set for hearing on the 18th day of December, 2018, at the hour of 8:30 o’clock A.M., before Judge Terrell S. Crossen, in Courtroom #VII of the District Courthouse of Rogers County, 200 South Lynn Riggs Boulevard, Claremore, Oklahoma, 74017, (918) 923-4961, at which time the Court will hear evidence in support of and in opposition to the granting of the AWOC Application at the time and place shown above, where you will have the right to object to the Court’s determination that the Child is eligible for adoption without your consent and to the entry of a judgment and decree declaring the Child eligible for adoption without the your consent.
TAKE FURTHER NOTICE that Petitioners have alleged in the AWOC Application that your consent to this adoption is not required because, for a period of twelve (12) consecutive months out of the last fourteen (14) months immediately preceding the filing of the Petition for Adoption, you willfully failed, refused, or neglected to contribute to the support of the Child, thereby benefitting the Child by providing a necessity, either in substantial compliance with an order entered by a court of competent jurisdiction adjudicating the duty, amount, and manner of support; or according to your financial ability to contribute to the Child’s support, pursuant to OKLA. STAT. tit. 10, § 7505-4.2(B);
FURTHER, that, to the extent that you are or may be entitled to custody of the Child, you have abandoned the Child, including, but not limited to, having failed to maintain a substantial and positive relationship for a period of six (6) consecutive months out of the last fourteen (14) months preceding the filing of the Petition for Adoption, pursuant to OKLA. STAT. tit. 10, §§ 7501-1.3 and 7505-4.2(G).
FURTHER, that, to the extent you may have established a substantial and positive relationship with the Child, you, for a period of twelve (12) consecutive months out of the last fourteen (14) months immediately preceding the filing of the Petition for Adoption, failed to maintain a substantial and positive relationship with the Child, having failed to maintain frequent and regular contact with the Child through frequent and regular visitation or frequent and regular communication to or with the Child and having failed to exercise parental rights and responsibilities, pursuant to OKLA. STAT. tit. 10, §§ 7501-1.3 and 7505-4.2(H)(1) and (3).
FURTHER, to the extent you do not appear, that you will have failed to appear for hearing after all notice requirements of 10 O.S. § 7505-4.1 were met, pursuant to 10 O.S. § 7505-4.2 (F).
YOU ARE, THEREFORE, NOTIFIED THAT THE COURT WILL HEAR EVIDENCE IN SUPPORT OF AND IN OPPOSITION TO THE GRANTING OF THE AWOC APPLICATION AT THE TIME AND PLACE SHOWN ABOVE, WHERE YOU WILL HAVE THE RIGHT TO BE PRESENT, HAVE AN OPPORTUNITY TO BE HEARD AT SAID TIME AND PLACE, AND HAVE THE RIGHT TO OBJECT TO THE GRANTING OF THE AWOC APPLICATION AND TO THE ADOPTION OF THE CHILD.
YOUR FAILURE TO APPEAR AT SAID HEARING SHALL CONSTITUTE A DENIAL OF YOUR INTEREST IN THE CHILD, WHICH DENIAL MAY RESULT, WITHOUT FURTHER NOTICE TO YOU IN THIS PROCEEDING OR IN ANY SUBSEQUENT PROCEEDINGS, IN THE GRANTING OF SAID AWOC APPLICATION, IN THE TERMINATION OF YOUR PARENTAL RIGHTS, IF ANY, TO SAID CHILD, AND IN THE CHILD’S ADOPTION WITHOUT YOUR CONSENT, ALL IN ACCORDANCE WITH THE LAWS OF THE STATE OF OKLAHOMA.
A copy of the AWOC Application is available upon application to the Court.
