ORDER FOR APPOINTMENT OF RAMA IULE AS PERMANENT KINSHIP GUARDIAN OF AYVAH ROMERO, A MINOR CHILD
THIS MATTER, having come before the Court on November 1, 2018, upon Petitioner’s Petition for Kinship Guardianship, Petitioner Rama Iule n/k/a Michelle Rama Iule appearing in person and through her counsel of record , Justice Legal Group (Anthony D. Griego), Respondent Danielle Tenorio n/k/a Danielle Chavez appearing in person, Pro Se. The Court upon hearing from the parties, reviewing the record and otherwise being fully apprised FINDS:
1. This Court has jurisdiction over the subject matter of this action and personal jurisdiction over the parties hereto.
2. The Petitioner, Rama Iule, is the maternal aunt of the minor child, Ayvah Romero, born May 2014.
3. Biological mother consents to the appointment of Rama Iule as Kinship Guardian of Rama Iule and understand the consequences of their consent to the instant action.
4. The Minor Child shall continue to live and reside with the Petitioner serves the best interests of the Minor Child.
5. Petitioner’s Petition is well-taken and should be granted.
6. Petitioner shall be permitted to make all decisions regarding the Minor Child and shall make all decisions and manage all aspects of the Minor Child’s personal care and well-being, without limitation, including but not limited to, any and all decisions regarding medical, health, and dental care, both elective and non-elective procedures, residence, education, employment, habitation and visitation with her biological mother and father.
7. The Minor Child, Ayvah Romero, shall remain under the sole, primary, physical custody, care and control of the Petitioner, subject to reasonable and well-defined timesharing with the minor child’s biological mother.
8. The minor child and the Respondent shall have timesharing every Saturday from 10 a.m. through 5 p.m. The exchanges shall take place at the Main Library Branch Downtown Albuquerque. Respondent shall also have a dinner visit every other Wednesday from 6:00 p.m. through 7:00 p.m. which shall occur at the McDonalds near Rio Grande and Central.
9. In the event a party cancels the timesharing they shall provide 4 hours notice to the other party.
10. The Respondent, Danielle Tenorio, is required to provide 9 months of clean drug tests via a hair folicle test prior to filing a Motion to Terminate Kinship Guardianship.
11. The Petitioner is required to provide Notice by Publication to the minor child’s father, Paul Romero which can be done through a publication of general circulation.
12. The Petitioner shall provide notice to the San Felipe Tribe of the kinship guardianship.
All other orders of the Court not in contrary herewith shall remain in full force and effect.
