EX PARTE ORDER
THIS MATTER came before the Court on December 10, 2018, for a hearing on Petitioner’s Emergency Motion to Stop Visitation. The Petitioner, was present and appeared with her attorney, Karin L. Henson, Esq. Respondent, was not present. The Court, having reviewed the file, heard offers of proof from counsel and being otherwise advised, FINDS:
1. The Court has jurisdiction over the parties, the parties’ minor child and subject matter herein.
2. The parties are the parents of one minor child: Maya Silva, age 7.
3. Respondent-Father has been charged with drug related charges in Sandoval County;
D-1329-CR-2018-00531 which have raised a concern for the safety of the minor child.
4. Respondent-Father’s joint legal custody and time-sharing with the minor child are suspended pending full review of this matter.
5. Counsel for Petitioner shall serve a copy of Petitioner’s Emergency Motion to Stop Visitation and this Ex Parte Order by publication in the Health City Sun for two (2) weeks, as well as, mail a copy of same to Respondent-Father’s last known address at his Mother’s home.
6. A hearing is scheduled for Janaury 30, 2019 at 1:30 p.m. for thirty (30) minutes.
This will be the only notice given.
7. All other Orders not modified herein remain in full force and effect.
