CIVIL ACTION TO QUIET TITLE,

TERMINATE TRUSTS AND FOR THE CREATION OF A RESULTING TRUST

The Plaintiff in this action seeks to quiet title to a parcel of real property located at 104

Woodward Ave. SW in Albuquerque, Bernalillo County, New Mexico, more particularly

described as:

A tract of land being the East two (2.00) acres of a five- (5.00) acre tract and described

by survey made by Ross Engineering Office in January 1936, said two- (2.00) acre tract

being more particularly described by survey made by Hall Surveying Co. in April and May

1975, and being a portion of Tract No. 90, as shown on the Amended Map No. 44 of the

Middle Rio Grande Conservancy District, Bernalillo County, New Mexico, and

BEGINNING at the Southeast corner of the tract herein described, being a point on the

Westerly right-of-way line of A.T. & S.F. Railway, from whence the Southwest corner of

Section 32, Township 10 North, Range 3 East, N.M.P.M. bears S. 31 Deg. 40 Min. W., at

1759.6 feet; Thence N. 85 Deg. 38 Min. W., 292.77 feet; Thence N. 8 Deg. 57 Min. E.,

298.66 feet to a point on the South line of Woodward Road; Thence S. 85 Deg. 35 Min.

E., along said South line of Woodward Road, 292.75 feet to a point on the Westerly

right-of-way line of said A.T. & S.F. Railway; Thence, S. 8 Deg. 57 Min. W., along

said Westerly right-of-way line of A.T. & S.F. Railway, 298.40 feet to the point of beginning and containing two (2.00) acres, more or less.

The defendants to be served by this notice are:

• Defendant Victor J. Dugger if living; if deceased, his unknown heirs,

• Defendant John H. Wallace if living; if deceased, his unknown heirs,

• Defendant Charles F. Mann if living; if deceased, his unknown heirs,

• Defendant Hailey Mann,

• Defendant Abajo Investment Fund c/o Charles F. Mann, Trustee and

• Unknown persons who may claim a lien, interest or title adverse to the Plaintiff.
