NOTICE OF PENDENCY OF SUIT ON DEFENDANT ROBERT CASWELL INVESTIGATIONS, INC.

GREETINGS:

PLEASE BE ADVISED that an action for damages has been filed in the Second Judicial District Court for the County of Bernalillo, New Mexico by the following plaintiff: Byron Powdrell. The case has been assigned Bernalillo County Cause No. D- 202-CV-2018-006528 and has been assigned to District Judge Nancy Franchini. A copy of the Complaint may be obtained from Plaintiffs’ attorney, Gene N. Chavez at 1220 5th St. NW, Albuquerque, NM 87102.

The Complaint seeks the following relief: compensatory damages, emotional distress, judgment for punitive or exemplary damages; for all pre-judgment interest, as well as post-judgment; for plaintiff’s costs and expenses in this matter; for an award of

Plaintiff’s damages sufficient to compensate Plaintiff for the damages stemming from the

improper conduct of Defendant Robert Caswell Investigations, Inc. for an award of damages, for an award of damages and attorney’s fees pursuant to the Unfair Practices Act as may be deemed appropriate including treble damages as provided by said Statute; for an award of punitive damages against Defendant Robert Caswell Investigations, Inc. in accord with applicable law; for such other an additional relief as may be deemed proper in the circumstances.

If you are Defendant Robert Caswell lnvestigations, Inc., you must file an Answer to the Complaint with the Office of the Clerk of the Second Judicial District Court (Civil Division) at 400 Lomas N.W., Albuquerque, NM 87103 and mail a copy of your Answer to Plaintiffs’ counsel (Gene N. Chavez at 1220 5th St. NW, Albuquerque, NM 87102) within thirty (30) days of the publication of this Notice of Pendency of Suit. Failure to timely file and serve an Answer may result in a Default Judgment being entered against you and in favor of the Plaintiffs granting the Plaintiffs the relief that they request in their Complaint.
