PETITION FOR KINSHIP GUARDIANSHIP OF A MINOR
COMES NOW, the Petitioner, JAMES OGBORN, by and through his attorney GILES LAW FIRM, P.C. (Allen Giles), and for his Petition For Kinship Guardianship Of A Minor, states as follows:
1. I, JAMES OGBORN, of9217 Ridgefield Avenue, NEAlbuquerque,New Mexico87109, am the Uncle of the minor child, JENNA MARIE OGBORN.
2. The minor child is a resident ofBernalilloCountyand currently resides with Petitioner JAMES OGBORN.
3. The minor child JENNA MARIE OGBORN was born January 10, 2006 inAlbuquerque,New Mexico.
4. The biological mother of the minor child is RAMONA ANN OGBORN who resides at9217 Ridgefield Avenue, NE. Ramona Ann Ogborn has signed a Power of Attorney For Minor Child document assigning her rights to her brother, JAMES OGBORN.
5. The biological father of the minor child JENNA MARIE OGBORN is ENRIQUE SONNY CHAVEZ whose last known address was the Homeless Shelter (St. Martin’s) inAlbuquerque,NM.
6. Upon information and belief, Petitioner is not aware of any other pending matters concerning custody of the children.
7. The reasons that the minor child needs a guardian are that the biological mother is currently unable to provide care for the minor child and the biological father has not been involved the life of the minor child nor has he supplied any means of supporting the minor child. In addition, the minor child has been residing with Petitioner for a significant period of her life.
8. Petitioner agrees to accept the duties and responsibilities of guardianship.
9. The child is not subject to the provisions of the Federal Indian Child Welfare Act of 1978.
10. Upon information and belief, there are no pending matters pursuant to N.M.S.A 32A-4-1 et. Seq.
WHEREFORE, Petitioner prays the Court for judgment as follows:
a) Temporary guardianship of the minor child JENNA MARIE OGBORN; and
b) For any such other and further relief as the Court deems just and proper.
