NOTICE IS HEREBY GIVEN that on Tuesday July 10, 2012 at 10:00 a.m. at 5220 Second Street N.W., Albuquerque, New Mexico, 87107 (the “Sale Location”) the undersigned landlord David and Josie Padilla (“Landlord”) will offer for public sale and sell to the highest bidder, for cash, the following personal property (the “Property”) which will be at the Sale Location:

Two (2) Roll-off  metal dumpsters.  Each dumpster is a 30 cubic yard size and approximately 22 feet long, 8 feet wide and 6 feet high.

This sale is held in accordance with the landlord’s lien provisions of Sections 48-3-5, 48-3-13, and 48-3-14 of NMSA.   This sale is due to the default in payment of rent by Ray Aragon and PMC, Inc. (“Tenant”) under a July 1, 2007 Lease covering the premises located at5220 Second StreetNW, Suite A,Albuquerque,NM87107.

NOTICE IS FURTHER GIVEN that the proceeds of the sale will be applied first, to all costs and expenses of the sale, including the costs of publication of this notice; second, for payment of all sums due to Landlord under the Lease in the amount of $2,726 plus Landlord’s attorneys’ fees in the amount of $500; and third, the balance, if any, will be paid to Tenant.

NOTICE IS FINALLY GIVEN that the Landlord may bid and purchase the Dumpsters at the public sale and that it may apply all or a portion of the amounts due by Tenant toward the purchase price.
