NOTICE OF SALE

Notice is hereby given that the undersigned Special Master will, on the 11th day of September, 2012, at 11:00 a.m., at the office of Nicholas Cullander PC, 3300 N. But-ler, Ste. 201, Farmington, New Mexico 87401, sell and convey to the highest bidder for cash at the time of the sale all the right, title and interest of the above-named Defen-dants in and to the following described San Juan County, New Mexico, real estate:

That part of the East One-Half of the Southwest Quarter of the Northwest Quarter (E ½ SW ¼ NW ¼) of Section Thir-teen (13), in Township Thirty (30) North of Range Eleven (11) West, N.M.P.M., San Juan County, New Mexico, more particularly described as follows:

BEGINNING South 89°05’ East 649.8 feet and North 00°10’ East 1309.4 feet and South 88°59’ East 325.7 feet from the West Quarter corner of said Section Thirteen (13);

THENCE South 88°59’ East 325.7 feet;

THENCE South 00°20’ West 335.0 feet;

THENCE North 88°59’ West 325.0 feet;

THENCE North 00°13’ East 335.0 feet to the point of begin-ning.

The sale will be made pursuant to the Judgment In Rem, Decree Of Foreclosure, Order Of Sale And Appointment Of Special Master entered on July 30, 2012, in the above-entitled and numbered cause, which was a suit for judgment and foreclosure of a mortgage lien held by Plaintiff and in which Plaintiff was granted judgment in rem and has a lien against the above-described real estate in the amount of $523,310.30, plus interest at the annual rate of 6.00% from June 22, 2011, to the date of confirmation of the sale, plus additional costs and attorney’s fees necessary to protect the real estate, together with costs of sale including a reasonable Special Master’s fee. Plaintiff has the right to submit a bid verbally or in writing. Plaintiff may apply all or any part of its judg-ment to the purchase price in lieu of cash. At the date and time stated above, and at the discretion of the Special Master, the sale may be postponed and re-scheduled without the necessity of publishing a new notice of sale.

Notice is further given that the real property will be sold subject to any and all pa-tent reservations, easements, all recorded and unrecorded liens not foreclosed herein, and all recorded and unrecorded special assessments and taxes that may be due. Plaintiff and its attorneys disclaim all responsibility for, and the purchaser at the sale takes the property subject to, the valuation of the property by the county assessor as real or personal property, affixture of any mobile or manufactured home to the land, de-activation of title to a mobile or manufactured home on the property, if any, environ-mental contamination on the property, if any, and zoning violations concerning the property, if any.

Notice is further given that this sale may be subject to a bankruptcy filing, a pay off, a reinstatement or any other condition that would cause the cancellation of this sale. Further, if any of these conditions exist, this sale will be null and void. The successful bidder’s funds shall be returned, and the Special Master and Plaintiff shall not be liable to the successful bidder for any damages.

Notice is further given that the purchaser at such sale shall take title to the above described real property subject to any rights of redemption provided by applicable law.
