NOTICE OF SALE
Notice is hereby given that on Wednesday, May 1, 2013, at the hour of 10:00 a.m., at the front steps of the Bernalillo County Courthouse, 400 Lomas NW, Albuquerque, New Mexico 87103, the Court appointed Special Master, Ronald T. Taylor will offer for sale and sell to the highest bidder, for cash, the following described real estate situate in Bernalillo County, State of New Mexico, to-wit:
Lots numbered Fourteen (14), Fifteen (15), Sixteen (16), and
Seventeen (17) in Block numbered Six (6), of Mesa Verde Addition to the City of Albuquerque, New Mexico, as the same are shown and designated on the Plat of said Addition, filed in the Office of the County Clerk of Bernalillo County, New Mexico on November 17, 1939, in Plat Book C, folio 38,
more commonly known as 116 Vermont Street NE, Albuquerque, NM 87108.
This sale is to be held pursuant to and in accordance with the Judgment filed in the above-entitled cause on March 19, 2013, wherein the Plaintiff, Melida Tesch, was granted Judgment over and against Defendants Hector Moreno and Yolanda Moreno, and against the real property and improvements described herein in the total amount of One Hundred Eight Thousand Five Hundred Forty-One Dollars and Fifty-Three Cents ($108,541.53), which amount includes interest at the rate of 8.75% from March 19, 2013 until paid in full. The total amount due in addition to the above will include any property taxes due and owing through the date of sale, plus costs of sale, all as provided in the judgment.
Notice is further given that the real property and improvements concerned with herein will be sold as is and without warranty of any kind, and subject to any and all patent reservations, easements, all recorded and unrecorded liens not foreclosed herein, all recorded and unrecorded special assessments and taxes that may be due, and rights of redemption as provided in the Judgment.
Notice is finally given that should the Plaintiff herein bid and/or become the purchaser of said real estate and improvements at the foreclosure sale, Plaintiff may use any part of its judgment granted herein and heretofore as credit against the purchase price should it be the highest bidder, and the Plaintiff or the purchaser at the Foreclosure Sale, shall be entitled to immediate possession of the real property (and any improvements) more particularly described herein.
