NOTICE IS HEREBY GIVEN that in the above-mentioned and numbered cause, which is an action to foreclose a mortgage lien on the real property owned by Defendants Victor Raymond Zabel Sr. and Sandra K. Zabel, Summary and Default Judgment was entered on October 10, 2013, in the amounts hereinafter specified and the real estate was ordered sold by the Special Master at public auction.
NOTICE IS FURTHER GIVEN that on November 19, 2013, at the hour of 9:00 a.m. at the front of the main entrance to the Bernalillo County Courthouse, at 400 Lomas NW, Albuquerque, NM 87102, the undersigned will offer for sale and sell to the highest and best bidder for cash, payable immediately, the following described real estate in Bernalillo County, New Mexico, whose legal description is as follows:
Lots numbered Six (6), Seven (7) and Eight (8) in block numbered One (1) of the City Realty Co.’s Addition No. 2 to the City of Albuquerque, New Mexico, as the same is shown and designated on the plat thereof, filed in the office of the County Clerk of Bernalillo County, New Mexico, on July 23, 1927, in Plat book C1, Page 135, together with the Westerly one-half (Wly. ½) of the vacated alley adjacent to Lot 6, described above, and the Easterly one-half (Ely.1/2) of the vacated alley adjacent to Lots 7 and 8, described above, said alley being vacated in City of Albuquerque Commission Ordinance No. 2155 on July 10, 1962.
and which has a physical address of 3014 4th Street, NW, Albuquerque, NM 87107
to satisfy the Summary and Default Judgment entered in this cause in favor of Plaintiff in the total amount of $92,872.98. Plaintiff may also be entitled to additional attorney fees and costs incurred after the filing of the Motion for Summary and Default Judgment through the Special Master’s Sale process. Interest on this Summary and Default Judgment accrues at the Judgment rate of 8.75% per annum from October 10, 2013 through the date of the foreclosure sale. The amount of interest from October 10, 2013 through November 19, 2013 is $868.29.
The Summary and Default Judgment specified that the purchaser at such foreclosure sale shall take title free and clear of any and all claims and liens of the parties to this action, subject to the one-month period of redemption of Defendants, as provided by law, subject to any unpaid taxes, subject to patent reservations, covenants, easements, and restrictions of record, and subject to all recorded and unrecorded lien creditors not foreclosed herein.
The Summary and Default Judgment further specifies that the proceeds of the sale shall be applied in the following priority: expenses of conducting the foreclosure sale, including the Special Master=s fee and costs of publication, payment of the Summary and Default Judgment entered herein in favor of the Plaintiff, together with interest and additional attorney fees and costs, and the surplus, if any, to be paid into the registry of this Court to be disposed of as the Court may hereafter order and direct.
The Plaintiff may bid at the foreclosure sale and credit the amount of its Summary and Default Judgment, as a credit on its bid.
