NOTICE OF PENDENCY OF SUIT
GREETINGS:
PLEASE BE ADVISED that an action for personal injuries has been filed in the Second Judicial District Court for the County of Bernalillo, New Mexico by the following plaintiffs: David Mick & Danny Garcia. The case has been assigned Bernalillo County Cause No. D-202-CV-2013-07255 and has been assigned to District Carl J. Butkus. A copy of the Complaint may be obtained from Plaintiffs’ attorney, Gene N. Chavez at 1220 5th St. NW, Albuquerque, NM 87102.
The Complaint seeks the following relief: reasonable expenses of necessary medical care and treatment; pain and suffering; the lost earnings, lost household services; judgment for punitive or exemplary damages against defendants; for all pre-judgment interest, as well as post-judgment; for plaintiff’s costs and expenses in this matter; for this Court’s Order determining the rights and liabilities of the respective parties as to policy proceeds due and payable under the policy of insurance between Plaintiffs and Defendant and directing the parties to act in accord therewith; for an award of Plaintiffs’ damages sufficient to compensate Plaintiffs for the damages stemming from the improper conduct of Defendants; for an award of damages, plus attorney’s fees and costs, sufficient to compensate for Defendants’ bad faith conduct and breaches of the Unfair Insurance Practices Act in this manner; for an award of damages and attorney’s fees pursuant to the Unfair Practices Act as may be deemed appropriate including treble damages as provided by said Statute; for an award of punitive damages against Defendant in accord with applicable law; for such other an additional relief as may be deemed proper in the circumstances.
If you are a named Defendant, you must file an Answer to the Complaint with the Office of the Clerk of the Second Judicial District Court (Civil Division) at 400 Lomas N.W., Albuquerque, NM 87103 and mail a copy of your Answer to Plaintiffs’ counsel (Gene N. Chavez at 1220 5th St. NW, Albuquerque, NM 87102) within (30) days of the publication of this Notice of Pendency of Suit. Failure to timely file and serve an Answer may result in a Default Judgment being entered against you and in favor of the Plaintiffs granting the Plaintiffs the relief that they request in their Complaint.
