NOTICE OF SALE
NOTICE IS HEREBY GIVEN that on September 19, 2014 at 10:00 a.m. in front of the Bernalillo County Courthouse, 400 Lomas N.W., Albuquerque, New Mexico, the undersigned Special Master will offer for sale and sell to the highest bidder, for cash, the following real estate (the “Real Property”) located in Bernalillo County, New Mexico:
Tracts numbered One (1) and Two (2) of THE VILLAGE AT BELLA VISTA, UNIT 1, Bernalillo County, New Mexico, as the same is shown and designated on the plat thereof filed in the office of the County Clerk of Bernalillo County, New Mexico on July 6, 2005 in Map Book 2005C, Folio 237.
Street address: 12165 N. Hi-way 14, Sandia Park, New Mexico.
“Cash” for purposes of this sale shall mean cash or other immediately available funds.
This sale is held subject to any accrued but unpaid ad valorem taxes and subject to a one-month right of redemption.
This sale is held pursuant to the Stipulated Judgment of Foreclosure and Appointment of Special Master (the “Judgment”) entered on August 18, 2014 in the above-entitled action wherein the Court awarded Plaintiff-in-Intervention RGPL, LLC, judgment against Bella Vista Partners, LLC as follows: (i) the principal sum of $2,532,968.55; (ii) accrued interest in the amount of $57,290.20; (iii) unpaid late charges of $3,624.78; (iv) continuing interest on the unpaid principal balance at the rate of 16.75% per annum from March 1, 2014 until paid in full; and (v) RGPL’s attorneys’ fees and costs in the amount of $1,000; and further foreclosing the interest of Defendants Bella Vista Partners, LLC, Universal Constructors, Inc., East Mountain Partners, LLC, Leaf Funding, Inc., High Mesa Consulting Group, Inc., f/k/a Jeff Mortensen & Associates, Inc., Western Glass & Panels, Inc., and Coronado Wrecking & Salvage Co., Inc. in the Real Property.
NOTICE IS FURTHER GIVEN that the proceeds of the sale will be applied first, to all costs and expenses of the sale including the Special Master’s fees; second, for payment of all sums due RGPL by virtue of the Judgment; and third, the balance, if any, as the Court may further direct.
NOTICE IS FINALLY GIVEN that RGPL may bid and purchase the Real Property at the foreclosure sale and that it may apply all or a portion of the Judgment toward the purchase price.
