NOTICE FOR PUBLICATION OF TRUSTEE’S SALE
The following legally described trust real estate will be sold, pursuant to the New Mexico Deed of Trust Act and to the power of sale as provided in the deed of trust recorded June 3, 2014, as Document No. 20358, in Book 1897 at Page 77 of the records of Lea County, New Mexico, and recorded May 30, 2014 as Document Number 2014043142 in the records of Bernalillo County, New Mexico, at public auction to the highest bidder on the front steps of the county courthouse in Bernalillo County, New Mexico, in or near Albuquerque, New Mexico, on December 18, 2015, at 10:00 o’clock a.m. of that day:

Lot Nineteen (19), Block Nineteen (19), Second Unit of the Dale Bellamah Addition to the City of Hobbs, Lea County, New Mexico.

A tract of land situated in the Northeast Quarter of the Northwest Quarter (NE/4NW/4) of Section 34, Township 18 South, Range 38 East, N.M.P.M., Lea County, New Mexico and being more particularly described as follows:
Beginning at a point which lies North 80.00 feet and West 597.00 feet from the Northeast corner of Lot 1, Block 163, Highland Park Addition; thence North 61.20 feet; thence West 63.00 feet; thence South 61.20 feet; thence East 63.00 feet to the point of beginning.
Parcel Two is also known as 900 N. Thorp St., Hobbs NM 88240, and
Parcel Three:
Tract Seven (7) East of Arroyo of Plat Showing Land of Epimenio Herrera, as the same is shown and designated on the plat thereof filed in the office of the County Clerk of Bernalillo County, New Mexico on July 6, 1954 in Map Book A1, Folio 162, also known as Tract 41, Unit A, West of Westland, Row 1 in Section 30, T 10 N., R. 1 E., Bernalillo County, New Mexico.
Trustor defaulted under the terms of the loan as modified, by failing to pay as promised. As of April 16, 2015, Trustor owed Beneficiary $195,000 principal, $6,922.75 interest through 4/16/15, said interest accruing at $64.11 per diem thereafter, for total principal and interest of $201,922.75 as of April 16, 2015; Lender’s modification fee of $9,750.00; Sunwest Mortgage Co., Inc.’s modification fee of $3,750.00; a disbursement fee of $461.01; a close out fee of $37.45; late fees of $585.00; and Lender’s requested payoff quote fee of $21.40.
To cure the default, Trustor was required to pay the amounts above, totaling $216,527.61, and attorney’s fees in the amount of $150.00 plus $10.50 NM gross receipts tax ($160.50), per that demand letter issued April 16, 2015. Trustor did not cure the breach or default as required. Additional interest to date of sale is calculated at $15,579.73.
Therefore, with 243 days’ interest from April 16, 2015 to date of sale on December 18, 2015, plus Beneficiary’s additional costs of sale in the amount of $1,750.00, the sale amount shall be $233,857.34.
BENEFICIARY Nest Egg Investments, LLC elects to sell or cause to be sold the trust real estate as provided in the deed of trust. The Beneficiary and/or its assignees has the right to bid at such sale and submit its bid verbally or in writing. The Beneficiary may apply all or any part of its judgment to the purchase price in lieu of cash. The sale may be postponed and rescheduled at the discretion of the Trustee or its attorney.
NOTICE IS FURTHER GIVEN that the real property and improvements concerned with herein will be sold subject to any and all patent reservations, easements, all recorded and unrecorded liens not foreclosed herein, and all recorded and unrecorded special assessments and taxes that may be due. Beneficiary, Trustee, and its attorneys disclaim all responsibility for, and the purchaser at the sale takes the property subject to, the valuation of the property by the County Assessor as real or personal property, affixture of any mobile or manufactured home to the land, deactivation of title to a mobile or manufactured home on the property, if any, environmental contamination on the property, if any, and zoning violations concerning the property, if any. CAVEAT EMPTOR.
NOTICE IS FURTHER GIVEN that the purchaser at such sale shall take title to the above described real property subject to a one month right of redemption.
