NOTICE OF SALE
NOTICE is hereby given that on July 28, 2016, at 1:30 p.m., the undersigned Special Master or his agent will sell to the highest bidder at the Bernalillo County Courthouse, located at 400 Lomas Blvd, NW Albuquerque, NM 87102, all Defendants’ interest, rights, and title in the real property located at 1521 Kit Carson Avenue, SW Albuquerque, NM 87104 (if there is a conflict between the legal description and the street address the legal description shall control, and is more particularly described as follows:
LOT NUMBERED ELEVEN (11) IN BLOCK NUMBERED TWENTY-FIVE (25) OF THE HUNING CASTLE ADDITION TO THE CITY OF ALBUQUERQUE, NEW MEXICO, AS THE SAME IS SHOWN AND DESIGNATED ON THE MAP OF SAID ADDITION, FILED IN THE OFFICE OF THE COUNTY CLERK OF BERNALILLO COUNTY, NEW MEXICO, ON MARCH 1, 1928
WITH MORTGAGE COVENANTS.
Including any improvements, fixtures, and attachments, such as, but not limited to, mobile homes. Subject to all taxes, utility liens and other restrictions and easements of record, and subject to a one month right of redemption by the Defendants upon entry of an order approving sale.
The sale will satisfy all or a portion of an In Rem Judgment entered on May 25, 2016, as follows: Judgment in the amount of $105,381.04 for Bank of America, with interest accruing at 5.9500% per year from September 4, 2015, forward, and then in the amount of $193,983.08 for BOKF, with interest at 6.80% on Note 1 and interest at 10.25% on Note 2, from May 24, 2013 forward. The Court reserves entry of final in rem judgment for the amount due after foreclosure sale, for additional costs and attorneys’ fees, plus interest as may be assessed by the Court.
The Judgment may be obtained from either the court clerk or the undersigned Special Master prior to the sale date. Bank of America, N.A. and BOKF, N.A., their assignees, their successor-in-interests, or their investors have the right to bid at the sale and submit such bid in writing to the special master, and may apply it to their judgments or a portion thereof to the purchase price in lieu of cash. For all other bidders, the sale terms are cash or its equivalent by the close of business on the day of sale. The sale may be postponed and rescheduled at the Special Master’s discretion. The Court’s decree, having duly appointed its Special Master to advertise and immediately offer for sale the subject real estate and to apply the proceeds of sale, first to the costs of sale and the Special Master’s fees, then to pay the above-described judgments in order of priority, interest and costs of sale, and to pay unto the registry of the Court any balance remaining.
PROSPECTIVE PURCHASERS AT SALE ARE ADVISED TO MAKE THEIR OWN EXAMINATION OF THE TITLE AND THE CONDITION OF THE PROPERTY AND TO CONSULT THEIR OWN ATTORNEY BEFORE BIDDING.
