NOTICE TO COUNSEL AND PARTIES
The enclosed Notice of Hearing sets one or more motions on a summary calendar.
Please meet and confer prior to the hearing date. If you are unable to meet and confer prior to the hearing date, please do so at the courthouse one-half hour before the hearing time.
Please sign in at the Domestic Relations Information Desk before the hearing time. Failure to arrive timely to meet and confer will almost certainly result in an attorney fee and/or inconvenience fee award. Your case will not be called until you have met and conferred.
If you are unable to resolve all the issues when you meet and confer, there will not be time for an evidentiary hearing on the summary calendar. Time permitting, counsel will be allowed to make offers of proof.
Please do not subpoena witnesses to appear at this hearing.
If one or both parties live outside Bernalillo County, you should consider filing a motion for permission to appear telephonically.
If a formal evidentiary hearing is necessary, your motion will be rescheduled with an appropriate amount of time allocated for the hearing. To avoid having to return to court another day, please use your meet and confer time wisely.
If your request for Relief is or includes a Motion for Interim Relief, 5 days prior to the hearing counsel and/or self-represented parties need to exchange completed Interim Income and Expense Affidavits, the prior years tax returns and year to date pay stubs; for self-employed parties you are required to produce the most recent profit and loss statement and a copy of CRS-1 forms for the last six months and income and expense statements for the last six months; all financial institution accounts, including checking and savings account statements for the past six months; credit card statements for the six month period preceding the date the petition was filed; all exhibits intended to be introduced. Counsel or self-represented parties are to promptly respond to opposing party’s requests for documentation of expenses.
