NOTICE OF SALE

NOTICE IS HEREBY GIVEN that on Friday, October 18, 2019, at the hour of 10:30 a.m., the undersigned Special Master will, at the main entrance of the Thirteenth Judicial Courthouse, 1835 Highway 314, Los Lunas, New Mexico, 87031, sell all right, title, and interest of Defendant Dale A. Davis and Ruth Davis, in and to the hereinafter-described real estate to the highest bidder for cash.  The property to be sold is situated in Valencia County, New Mexico, is commonly known as 400 Dalies Avenue, Belen, New Mexico, 87002, and has the following legal description:

LOTS(S) NUMBERED ELEVEN (11), TWELVE (12) AND THIRTEEN (13) IN BLOCK NUMBERED TWENTY-ONE (21) OF BELEN TOWNSITE, AS THE SAME IS SHOWN AND DESIGNATED ON THE PLAT THEREOF, FILED IN THE OFFICE OF THE PROBATE CLERK AND EX-OFFICIO RECORDER OF VALENCIA COUNTY, NEW MEXICO, ON JULY 26, 1909, IN MAP BOOK A16, FOLIO 508.

THE FOREGOING SALE will be made to satisfy a judgment rendered by the above Court in the above-captioned matter cause on September 13, 2019, in the total amount set forth in the judgment, this being an action to foreclose a mortgage on the above-described real property.  The Plaintiff has the right to bid at such sale and submit its bid verbally or in writing.  The Plaintiff may apply all or any part of its judgment to the purchase price in lieu of cash.  The sale may be postponed and rescheduled at the discretion of the Special Master.

NOTICE IS FURTHER GIVEN that the above-described real property and any improvements concerned with herein will be sold subject to easements, reservations and restrictions of record; taxes and governmental assessments including unpaid utility bills; any liens or encumbrances not foreclosed in this proceeding; the valuation of the property by the County Assessor as real or personal property; affixture of any mobile or manufactured home to the land; deactivation of title to a mobile or manufactured home on the property; environmental contamination, if any; any homeowners’ association or condominium dues, assessments, declarations, rules, requirements and restrictions; any requirements imposed by city or county ordinance or by state law affecting the property; and zoning violations concerning the property, if any.  No representation is made as to the validity of the rights of ingress and egress.  Transfer of title to the highest bidder shall be without warranty or representation of any kind.  ALL PROSPECTIVE PURCHASERS AT THE SALE ARE ADVISED TO INDEPENDENTLY REVIEW THE DISTRICT COURT FILE, TO MAKE THEIR OWN EXAMINATION OF TITLE AND TO CONSULT THEIR OWN ATTORNEY BEFORE BIDDING.

NOTICE IS FURTHER GIVEN that the purchaser at such sale shall take title to the above-described real property subject to a one (1) month right of redemption.
