TO: Walter S. Cotton, Jr., Rose M. Cotton, The Unknown Heirs of Walter S. Cotton, Jr. and Rose M. Cotton:
YOU ARE HEREBY NOTIFIED that an action has been commenced against you in the above-captioned court and cause by the above-named Plaintiff and that the Plaintiff seeks to obtain constructive service of process upon you by publication. The general subject of the action is the condemnation of property. The property is:
The Southwest Quarter of the Northwest Quarter of the Northwest Quarter (SW1/4NW1/4NW1/4) of Section Twenty-four (24), Township Nine (9) North, Range One (1) East, N.M.P.M., Bernalillo County, New Mexico.
(the “Property”). It is alleged in the Petition for Condemnation (the “Petition”) that an easement is necessary for the public purpose of installing, maintaining, and operating a transmission line. The Petition seeks, in addition to other relief, condemnation of an easement on the Property. No personal judgment is sought against you at this time, because neither personal service on you, nor an acceptable substitute, has been accomplished.
YOU ARE FURTHER NOTIFIED that unless you enter or cause to be entered your appearance in said cause on or before 30 days after the third consecutive day of publication in the Valencia County News-Bulletin, judgment will be entered by default and the relief prayed for in the Petition will be granted.
