NOTICE OF SALE ON FORECLOSURE
PLEASE TAKE NOTICE that the above-entitled Court, having appointed me as Special Master in this matter with the power to sell, has ordered me to sell the real property (“Property”) situated in Bernalillo County, New Mexico, commonly known as 3936 Silver Avenue SE, Albuquerque, New Mexico 87108, and more particularly described as follows:
A PARCEL OF LAND SITUATED IN THE STATE OF NEW MEXICO, COUNTY OF BERNALILLO, WITH A STREET LOCATION ADDRESS OF 3936 SILVER AVE SE, ALBUQUERQUE, NM 87108-2642 CURRENTLY OWNED BY ANTHONY M. MEDINA HAVING A TAX IDENTIFICATION NUMBER OF 1-017-057-135-191-3-26-15 AND BEING THE SAME PROPERTY MORE FULLY DESCRIBED IN BOOK/PAGE OR DOCUMENT NO. 2007067941 DATED 5/8/2007 AND FURTHER DESCRIBED AS LT 10-A PLAT OF LOTS 1-A THRU 20-A INCLUSIVE SILVER STREET TOWNHOMES CONT .0694 AC.
The sale is to begin at 10:00 a.m. on January 24, 2020 outside the front entrance of the Bernalillo County District Courthouse, 400 Lomas NW, Albuquerque, New Mexico 87102 at which time I will sell to the highest and best bidder for cash in lawful currency of the United States of America the Property to pay any expenses of sale, and to satisfy the Judgment granted Plaintiff on December 16, 2019 against Defendant Anthony M. Medina, in the amount of $46,422.82, plus outstanding interest due on the Note in the amount of $11,638.08 through May 1, 2019, and accruing thereafter at the rate of 8.00% per annum or $10.17 per day, plus late charges of $840.00, plus annual fees of $105.00, plus attorney’s fees and costs incurred in connection with this foreclosure action in the amount of $3,142.65, plus special master’s fees and all other costs of foreclosure sale, plus post-judgment interest at the rate of 8.00% per annum from the date of judgment until paid.
NOTICE IS FURTHER GIVEN that the real property and improvements concerned with herein will be sold subject to any and all patent reservations, easements, all recorded and unrecorded liens not foreclosed herein, a prior mortgage interest as set forth in the Judgment, and all recorded and unrecorded special assessments and taxes that may be due. Plaintiff and its attorneys disclaim all responsibility for, and the purchaser at the sale takes the property subject to, the valuation of the property by the County Assessor as real or personal property, affixture of any mobile or manufactured home to the land, deactivation of title to a mobile or manufactured home on the property, if any, environmental contamination on the property, if any, and zoning violations concerning the property, if any.
