NOTICE OF MOTION FOR ORDER DETERMINING HEIRSHIP OR, ALTERNATIVELY, PETITION FOR INSTRUCTION REGARDING REASONABLE DILIGENCE TO IDENTIFY AND ASCERTAIN JANE DOE #1 AND JANE DOE #2
TO: JETHRO T. BALL; AND ALL UNKNOWN HEIRS AND ALL UNKNOWN PERSONS CLAIMING ANY RIGHT, TITLE OR INTEREST IN OR TO THE ESTATE OF ANDREW A. BALL, DECEASED.
JETHRO T. BALL has filed a Motion for Order Determining Heirship Or, Alternatively, Petition for Instruction Regarding Reasonable Diligence to Identify and Ascertain Jane Doe #1 and Jane Doe #2 requesting the Court to enter an Order which (1) approves as reasonable diligence Petitioner’s efforts to ascertain the existence, identity and whereabouts of JANE DOE #1 and JANE DOE #2 as referenced in the Original Petition; (2) determines that there is insufficient information reasonably available to the Personal Representative to determine the existence, identity and whereabouts of JANE DOE #1 and JANE DOE #2 after a due and diligent search; (3) determines that Petitioner JETHRO T. BALL is the sole identified heir-at-law of the Decedent; (4) approves, allows and directs the Personal Representative to distribute all of the Decedent’s property to Petitioner JETHRO T. BALL as the sole identified heir-at-law of the Decedent; and (5) grants such other and further relief as may be proper OR, alternatively, to enter an Order which (1) directs the Personal Representative in any further effort to determine the existence, identity and whereabouts of Jane Doe #1 and Jane Doe #2 as referenced in the Original Petition and (2) grants such other and further relief as may be proper. Notice is hereby given that a hearing on such Motion will be held telephonically (800-747-5150 and enter code 9254116) at the Second Judicial District Court of Bernalillo County in Albuquerque, New Mexico, before the Honorable Judge Erin O’Connell on Thursday, August 6, 2020 at 9:00 a.m.
