HEARING OFFICER REPORT RECOMMENDING SERVICE BY PUBLICATION
AND NOTICE OF FILING
This matter came before the Hearing Officer on December 10, 2020 for hearing on Petitioner’s Objections to Hearing Officer Report filed November 6, 2020. In the interest of judicial economy, the Hearing Officer also heard Petitioner’s Verified Motion for Service by Publication, filed November 6, 2020. Petitioner appeared and represented herself, pro se. Respondent did not appear and had not been served.
The Hearing Officer, having reviewed the Court pleadings, heard testimony from the Petitioner and being otherwise fully advised , FINDS AND RECOMMENDS:
1. The Petition for Dissolution of Marriage was filed on November 13, 2018.
2. Petitioner testified that she has attempted to locate Respondent by speaking with a member of his family, conducting internet searches and researching Court records. She is unable to locate the Respondent and believes his is living on the streets.
3. This Hearing Officer finds that Petitioner made diligent efforts to make personal service, but has not been able to complete service of process
4. This Hearing Officer finds that the newspaper of general circulation in this county is the Health City Sun, and that this newspaper is most likely to give Respondent notice of the pendency of this action.
5. Petitioner shall serve process on Respondent by publication once a week for three consecutive weeks in the Health City Sun. The notice shall inform Respondent that a divorce petition has been filed and that the action is pending in this Court.
6. Petitioner shall shall file proof of service with a copy of the Affidavit of Publication when service has been completed.
7. Petitioner is encouraged to contact the Self-Help Division, Room 119 of the Courthouse, to address next steps after service by publication is complete.
You have ten (10) working days from the filing date to serve written objections to the Recommendations on the parties and file the objections with the District Court.
