I, David S. Borunda, Court Administrator of the Third Judicial District Court in the County of Doña Ana, State of New Mexico, do hereby cause to be issued this Notice of Pendency of Suit, for the purpose of service of process on heirs of Estanislada Lopez, Alejandro M. Lopez, Alejandro Lopez, Jr., Carmelita Lopez, Evanjilita Lopez, Julian Lopez, Jesusita M. Lopez, Benancia Lopez Nunez, Carmen Nunez Oliver, Ed Oliver, David Oliver, Roger Oliver, Caytano Nunez, Gloria Nunez Smith, Sammy Smith, Salomon Nunez, Moises Nunez, Victor Nunez, Gregoria M. Lopez, Francisco Lopez, Hidalgo Lopez, Ysidro Montoya, Romilia Avalos, Celia Gonzales, Alicia Montoya, Eulalia Ontiveros, Francisco Montoya, Manuel Ramos, Margarita Kaharoeddin, and Ernest Nunez, and any and all unknown claimants of interest in the premises adverse to Plaintiffs by publication.
The names of the Plaintiff, Defendants, and the Court in which said cause is pending and the civil cause number are set out hereinabove.
The Defendants against whom service by publication is sought to be obtained are heirs of Estanislada Lopez, Alejandro M. Lopez, Alejandro Lopez, Jr., Carmelita Lopez, Evanjilita Lopez, Julian Lopez, Jesusita M. Lopez, Benancia Lopez Nunez, Carmen Nunez Oliver, Ed Oliver, David Oliver, Roger Oliver, Caytano Nunez, Gloria Nunez Smith, Sammy Smith, Salomon Nunez, Moises Nunez, Victor Nunez, Gregoria M. Lopez, Francisco Lopez, Hidalgo Lopez, Ysidro Montoya, Romilia Avalos, Celia Gonzales, Alicia Montoya, Eulalia Ontiveros, Francisco Montoya, Manuel Ramos, Margarita Kaharoeddin, Ernest Nunez and any and all unknown claimants of interest in the premises adverse to Plaintiffs.
The general object of this action is to quiet and to set at rest the title of Plaintiff in and to the lands described herein against any adverse claims of the Defendants and that the Defendants be barred and estopped from having or claiming any lien upon, any right or title to the estate of Plaintiff in and to said lands, or any portion thereof, adverse to the Plaintiff.
The property which is affected and concerned by this pending action is located in Doña Ana County, New Mexico, commonly addressed as 343 San Jacinto Road, and more particularly described as follows, to wit:
A parcel of land in the confirmed portion of the Refugio Colony Grant described as follows: Beginning at a concrete monument set at the NW corner of County Plat No. 1664 for the NW corner of this land, whence the SW corner of Section 18,, Twp. 26 S., R.3 East of the NMPM, as surveyed by the U.S.R.S. bears S. 65 deg. 34’ 48” West. 1123.84 feet; thence N. 58 deg. 21’ 48” East, 326.01 feet to a concrete monument; thence N. 59 deg. 52’ 22” East, 812.16 feet to the NE corner hereof; thence S. 40 deg. 15’ East, 537.01 feet to the SE corner hereof, a point in the Northerly toe of slope of the Northerly spoil bank of forty foot community lateral; thence following the said Northerly toe of slope of the Northerly spoil bank of the said community lateral with the following courses and distances: S. 36 deg. 58’ West, 15.92 feet; thence S. 81 deg. 14’ West, 151.00 feet; thence S. 59 deg. 28’ West 269.20 feet; thence S. 29 deg. 06’ West, 422.20 feet; thence S. 3 deg. 57’ West, 77.10 feet to the SW corner hereof; thence N. 65 deg. 23’ 16” West, 757.48 feet to the NW corner hereof and place of beginning, containing 11.00 acres, more or less (hereinafter “the Property”).

Lopez, Benancia Lopez Nunez, Carmen Nunez Oliver, Ed Oliver, David Oliver, Roger Oliver, Caytano Nunez, Gloria Nunez Smith, Sammy Smith, Salomon Nunez, Moises Nunez, Victor Nunez, Gregoria M. Lopez, Francisco Lopez, Hidalgo Lopez, Ysidro Montoya, Romilia Avalos, Celia Gonzales, Alicia Montoya, Eulalia Ontiveros, Francisco Montoya, Manuel Ramos, Margarita Kaharoeddin, Ernest Nunez and any and all unknown claimants of interest in the premises adverse to Plaintiffs, against whom constructive service is sought to be obtained, are hereby notified that unless they file a responsive pleading or motion with this Court within thirty (30) days after the date of the third and last publication of this notice, judgment or other appropriate relief will be rendered in such suit against them by default.
