VERIFIED PETITION FOR DISSOLUTION OF MARRIAGE
(WITHOUT CHILDREN)
COMES NOW Petitioner, QUAN LA, by and through his attorneys, Clear & Clear, P.A., by Thomas J. Clear, III, Esq., and for his Verified Petition for Dissolution of Marriage (Without Children), respectfully, STATES:
1. Petitioner is and has been, at all times material herein, a resident of the County of Bernalillo, State of New Mexico.
2. Petitioner has resided in the County of Bernalillo, State of New Mexico, for at least six
(6) months immediately preceding the filing of the present Petition for Dissolution of Marriage (Without Children) and has domicile in New Mexico as defined by Section 40-4-5 NMSA 1978.
3. Petitioner and Respondent were married on May 22, 2015 in Hanoi, Republic of Vietnam, and have remained spouses since that date.
4. A state of incompatibility and irreconcilable differences exists and the parties are not likely to reconcile.
5. Petitioner and Respondent have no children from this union and none are expected as of the date of the filing of the petition herein.
6. The parties have accumulated certain assets, both real and personal property, and have incurred certain debts and they should be divided appropriately.
WHEREFORE, Petitioner, QUAN LA, prays that This Honorable Court grant the following relief:
A. That an order be entered granting the parties a Final Decree of Dissolution of Marriage on the grounds of incompatibility.
B. Confirm any separate property and separate debts of the parties.
C. Equitably divide any community property and community debt of the parties.
D. For such other relief as the Court deems just and proper given the circumstances.
