GREETINGS:
You are hereby notified that an action has been commenced and is now pending in the District Court of Bernalillo County, New Mexico, Anna Louise Padilla Rodriguez, as (“Petitioner”), Petitioner is the Petitioner and you are the Respondent, said cause number being No. D-202-PB-2021-00257 on the civil docket of said Court.
The objects and purposes of the action are to remove you as the Co-Trustee of the Anna R. Padilla Revocable Trust and for damages based on your breach of fiduciary duty, all as more particularly prayed for and set forth in the Verified Petition to Remove Co-Trustee. You are further notified that unless you enter your appearance in said cause within thirty (30) days of this service pursuant to NMRA 1-004 and file a responsive pleading or motion within such time, judgment by default may be rendered in said cause against you for failing to appear, and the Petitioner will apply to the Court for the relief demanded in this Petition.
