PETITION FOR DISSOLUTION OF MARRIAGE, DETERMINATION OF CHILD CUSTODY, AND SETTING OF CHILD SUPPORT
COMES NOW Petitioner Dennis Sanchez, by and through his attorney, Shannon Robinson, and for his Petition for Dissolution of Marriage states the following:
1. Petitioner lives in Bernalillo County and has done so for more than 6 months preceding the filing of this Petition.
2. That Respondent Desiree R. Sanchez’ last known address is 12999 Central Avenue NE 87123 at Extended Suites and RV Park in Bernalillo County.
3. Petitioner lives at 612 Dorothy Street NE, 87123 in Albuquerque, New Mexico.
4. Respondent is a United States citizen born June 5, 1980.
5. The Parties were married on June 5, 2001 in Bernalillo County.
6. Two children were born of this marriage:
Dennis Sanchez Jr. was born of this marriage and is twenty years of age. Desiree M. Sanchez was born on April 4, 2005.
Both children are New Mexico residents, and should not leave the State of New Mexico or the USA without permission of the Court.
7. The parties have community property and community debts to be divided by the
Court.
8. The Respondent may not qualify to be awarded legal and physical custody of both children.
9. Both children reside with their father.
9. Child support should be waived by Court Order.
10. A state of incompatibility and irreconcilable differences exists such that the purpose of their marriage can no longer be fulfilled and the parties are not likely to reconcile. The marriage is requested to be dissolved.
11. Visitation of the children should be established between the parties and child support awarded.
12. The Petitioner is seeking sole physical and legal custody of the minor child.
13. An Order of Dissolution of Marriage should be entered, legal and physical custody of the minor child determined, child support awarded and property and debts divided.
WHEREFORE, Petitioner Dennis Sanchez seeks a Decree of Dissolution of Marriage from this Court.
