NOTICE OF PENDENCY OF SUIT
THE STATE OF NEW MEXICO TO: Any and all unknown claimants of interest in the premises adverse to Plaintiff
I, David S. Borunda, Court Administrator of the Third Judicial District Court in the County of Doña Ana, State of New Mexico, do hereby cause to be issued this Notice of Pendency of Suit, for the purpose of service of process on any and all unknown claimants of interest in the premises adverse to Plaintiff by publication.
The names of the Plaintiff, Defendants, and the Court in which said cause is pending and the civil cause number are set out hereinabove.
The Defendants against whom service by publication is sought to be obtained are any and all unknown claimants of interest in the premises adverse to Plaintiff.
The general object of this action is to quiet and to set at rest the title of Plaintiff in and to the lands described herein against any adverse claims of the Defendants and that the Defendants be barred and estopped from having or claiming any lien upon, any right or title to the estate of Plaintiff in and to said lands, or any portion thereof, adverse to the Plaintiff.
The property which is affected and concerned by this pending action is located in Doña Ana County, New Mexico, and more particularly described as follows, to wit:
A certain parcel of land situate within Sections 17, Township 23 South, Range 1 East, New Mexico Principal Meridian, Dona Ana County, New Mexico and being more particularly described by metes and bounds as follows:
Beginning at a set 5/8” rebar with a yellow cap, No. 5948, at the southwest corner of the parcel herein described said point being on the westerly boundary of the parcel herein described, whence the found 1” Iron Pipe on the section corner common to Sections 16, 17, 20, and 21 bears S24°54’13”E, a distance of 1180.56 feet;
THENCE, continuing along the west boundary, N00°41’28”E, a distance of 274.21 feet to a set 5/8” rebar with a yellow cap, No. 5948, on the northwest corner of the parcel herein described;
THENCE, continuing along the north boundary, S76°42’00”E, a distance of 216.66 feet to a set 5/8” rebar with a yellow cap, No. 5948. On the northeast corner of the parcel herein described;
THENCE, S24°20’02”W, a distance of 175.73 feet to a set 5/8” rebar with a yellow cap, No. 5948;
THENCE, S61°10’57”W, a distance of 133.25 feet to a set 5/8” rebar with a yellow cap, No. 5948;
THENCE, N90°00’00”W, a distance of 25.00 feet to the POINT OF BEGINNING of the parcel herein described, said parcel containing 38,815 square feet or 0.891 acres of land, more or less.

Any and all unknown claimants of interest in the premises adverse to Plaintiff, against whom constructive service is sought to be obtained, are hereby notified that unless they file a responsive pleading or motion with this Court within thirty (30) days after the date of the third and last publication of this notice, judgment or other appropriate relief will be rendered in such suit against them by default.
